PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider the petitioner’s representation dated 08.12.2025 in accordance with order passed by this Court in W.P.No.9483 of 2022 dated 15.10.2024 and A.P.No. 299 of 2014 dated 15.02.2018 and consequentially direct the respondent to reinstate the petitioner in service with continuity of service and all other attendant benefits within any time limit as framed by this Court and to pass orders.

ORDER

The writ petition has been filed seeking a mandamus to the respondents to consider the representation of the petitioner dated 08.12.2025 in accordance with the order of this Court in W.P.No.9483 of 2022 and A.P.No.299 of 2014 and to reinstate the petitioner in service with continuity of service and all other attendant benefits.

2. The case of the petitioner is that he had joined the services of the

respondent on 19.03.2008 as a Conductor and was dismissed from service on 07.11.2014. The respondent-Management had filed an approval petition in A.P.No.299 of 2014 and the same was dismissed on 15.02.2018. Hence, the petitioner had approached the respondent with several representations to reinstate him into service, however, the same was not considered. Aggrieved by the same, the petitioner had filed W.P.No.30800 of 2018 before this Court to consider his representations and to reinstate him into service. This writ petition was allowed on 21.06.2018. The petitioner would further submit that the respondent-Management on their part had filed W.P.No.9483 of 2022 challenging the order in A.P.No.299 of 2014, however, the same was dismissed by order dated 15.10.2024.

3. The grievance of the petitioner is that despite the directions of this

Court to reinstate him into service, the respondent has not taken any steps in this regard. The petitioner would further submit that he has not been gainfully employed elsewhere after his termination in the year 2017. Of the several representations to the respondent, his last representation seeking to reinstate him into service, is the one dated 08.12.2025. None of his representation including his recent representation dated 08.12.2025 was considered to date. Hence, the petitioner is before this Court.

4. Heard the learned counsel on either side and also perused the materials placed before this Court.

5. Considering the grievance expressed by the petitioner and the limited

scope of prayer is only to consider his representation dated 08.12.2025 with respect to reinstating him into service and to pay him all attendant benefits, this Court directs the respondent to consider the representation of the petitioner and pass speaking orders within a period of two weeks from the date of receipt of a copy of this order.
