ORDER
The petition has been filed seeking a direction to the respondents to consider the petitioner’s representation dated 02.12.2024 and consequently direct them to disburse his retirement benefit.
2. It is the case of the petitioner that the petitioner was working as Village
Administrative Officer at Ichiputhur Village, Arakkonam Taluk, Vellore. During his service, he was arrested under Prevention of Corruption Act, 1988, due to which, the third respondent vide its proceedings dated 17.02.2004, suspended the petitioner from service.
2.1. The petitioner made a representation dated 09.10.2006 to the first respondent for reinstatement. The first respondent received the same, considered and directed the second respondent to reinstate him. By proceedings dated 08.11.2006, the second respondent reinstated the petitioner and thereafter, he continued his service till his superannuation on 30.06.2012. All of a sudden, the fourth respondent issued a letter dated 30.06.2012 stating that the petitioner was not allowed to retire from service and suspended on 30.06.2012 due to pendency of the criminal case.
Page2 of 5 2.2. The petitioner would submit that initially after trial, he was convicted in the said criminal case. Aggrieved by the same, he preferred an
appeal before this Court in Crl.A.No.712 of 2018. This Court, by an judgment
dated 19.10.2024, acquitted the petitioner from all the charges. Thereafter, the
petitioner approached the first respondent with the certified copy of the order
dated 19.10.2024 and requested to disburse his retirement benefits. Since there is no response till date, the petitioner is before this Court.
3. It is brought to the notice of this Court by the learned Additional
Government Pleader that the respondents in Crl.A.No.712 of 2018 are proposing to file a Special Leave Petition before the Hon’ble Supreme Court of India and the same is yet to be filed.
4. Heard the learned counsel on either side and perused the materials available on record.
5. Considering the fact that the special leave petition is not yet filed,
there is no impediment as on date for the respondents, the respondents are directed to consider the petitioner’s representation dated 02.12.2024 and pass orders on merits by following due process of law within a period of two months from the date of receipt of a copy of this order.
