ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.10.2025 for the offences punishable under Sections 87 of BNS, 5(1), 6(1) of POCSO Act, 9 of Prohibition of Child Marriage Act, in Crime No.69 of 2025, registered on the file of the respondent police, seeks bail. Page1 of 4

2. The allegation against this petitioner is that, this petitioner is accused

of visiting the home of the victim girl aged about 17 years, taking advantage of her loneliness seduced her and kidnapped her and committed aggravated penetrative sexual assault. In the mean time, girl missing complaint was also lodged by her mother and the police have secured the victim girl and the petitioner is also arrested.

3. This is 4th bail petition. Earlier bail petition of the petitioner was

dismissed on 23.01.2026 in Crl.O.P.No.1524 of 2026 on the following reasons: “5.I have also gone through the statement recorded from the victim girl and it revealed that this petitioner is already a married man, seduced her and kidnapped her and committed aggravated penetrative sexual assault, hence, this Court is not inclined to grant bail to the petitioner at this stage.”

4. The learned counsel appearing for the petitioner submitted that investigation is concluded and the final report is filed. Hence, he prayed for grant of bail to the petitioner. Page2 of 4

5. Though it is stated that the final report is filed, considering the gravity
