ORDER

WMP.No.9195 of 2023 has been filed seeking to file a single writ petition. Since the petitioners are related to each, this petition is ordered on payment of single court fee.

2. This petition has been filed directing the 1 to 8 respondents to recover

the golden and silver ornaments belong to Arulmigu Sri Mariamman Thirukovil Situated at S.Valavanthi Village, Mohanur Taluk, Namakkal District from the 9th respondent and handover the same to the 5th respondent and further direct 1 to 8 respondents to celebrate panguni Chithirai festival for Arulmigu Sri Mariamman Thirukovil in April 2023.

3. It is the case of the petitioner that the petitioners are Poosaris of

Arulmigu Sri Mariamman Thirukovil Situated at S.Valavanthi Village, Mohanur Taluk, Namakkal District and their grievance is that gold and silver ornaments belonging to the subject temple were taken away by the 9th respondent/former Trustee. For recovery of the same, the present petition has been filed seeking for a direction.

4. The learned counsel for the petitioner submitted that as on date, either

the petitioners nor the 9th respondent has not handed over to the petitioners. Hence, seeks for a direction to the fifth respondent to file a formal complaint to the jurisdictional police station within a period of two weeks from the date of receipt of a copy of this order and the jurisdictional police be directed to conduct investigation and recover the gold and silver articles from the person in the manner known to law.

5. The learned Special Government Pleader and the learned Government

Advocate (HR & CE) would submit that if appropriate complaint is filed to the jurisdictional police, they will conduct investigation and pass appropriate orders as per law.

6. In such view of the matter, there shall be a direction to the fifth

respondent to file a formal complaint to the jurisdictional police within a period of two weeks from the date of receipt of a copy of this order, on reciept of complaint, the jurisdictional police shall conduct investigation and pass appropriate orders as per law.
