PRAYER in Crl.M.P.No.4164 of 2026: Criminal Miscellaneous Petition filed under Section 438(1) of BNSS Act, 2023, praying to suspend the sentence of one year simple imprisonment for the offence under Section 324 of IPC imposed on him by 1st Additional Assistant Sessions Court of Coimbatore in S.C.No.283/2015 dated 29.10.2021 and also confirmed by the 4th Additional District Court of Coimbatore in Criminal Appeal 177/2021 dated 15.12.2025 pending disposal of the connected criminal revision before this Court.

COMMON ORDER

The petitioner has preferred the above revision challenging the judgment

passed by the IV Additional District Court, Coimbatore, in Crl.A.No.177 of 2021 dated 15.12.2025, confirming the judgment of the I Additional Assistant Sessions Court of Coimbatore, convicting the petitioner for the following offences: Rank of the Conviction under Sentence awarded accused Sections To undergo simple imprisonment for one year and exempt the period 324 IPC on which the petitioner was in jail from 20.07.2015 to 11.08.2015 under Section 428 Cr.P.C

2. Aggrieved by the same, he filed Crl.R.C.No.549 of 2026 before this

Court, and the instant petitions have been filed to suspend the sentence imposed on the petitioner and to exempt the petitioner from surrendering before the Trial Court, pending disposal of the above Criminal Revision Case.

3. The case of the prosecution is that on 19.07.2015, petitioner asked one

Sakthivel to buy liquor for him, however, he has refused, which resulted in a verbal altercation between the petitioner and one Sakthivel. On the same day at about 16.30 p.m, the petitioner verbally abused the Sakthivel and took out the hidden knife and stabbed the Sakthivel on his back. Hence, a case was registered against the petitioner under Section 307 of IPC. After trial, the petitioner was found guilty under the offence punishable under Section 324 of IPC.

4. The learned counsel for petitioner would submit that he has raised substantial grounds in the revision.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Considering the fact that there are substantial grounds raised in the

above revision, which requires consideration and since the revision is not likely to be taken up in the near future, this Court is inclined to grant the relief of suspension of sentence to the petitioner.

7. Accordingly, these criminal miscellaneous petitions stand allowed. The

sentence imposed on the petitioner is suspended and the petitioner is exempted from surrendering before the Trial Court till the disposal of the above criminal revision, subject to the following conditions: (i)The petitioner shall execute a bond for a sum of Rs.10,000/-, with two sureties, each for a like sum to the satisfaction of the learned I Additional Assistant Sessions Court, Coimbatore; (ii)The petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank pass Book and mobile numbers to ensure their identity; and
