ORDER

These petition have been filed by the defacto complainant seeking cancellation of the statutory bail granted by the XVIII Metropolitan Magistrate, Saidapet, Chennai in Crl.M.P.No.12772 of 2024 dated 19.07.2024,, Crl.M.P.No.12773/2024 dated 19.07.2024, Crl.M.P.No.13115/2024 dated 29.07.2024, Crl.M.P.No.13471 of 2024 dated 01.08.2024 and Crl.M.P.No.12337 of 2024 dated 18.07.2024.

2. The learned senior counsel appearing on behalf of the petitioner herein

submitted that it is case of robbery and the accused/second respondent in all the petitions herein joined hands with other accused and robbed a sum of Rs.1.5 crores and immediately F.I.R was registered and totally 11 persons were arrested including the accused/second respondent in all the petitions and all of them have confined in prison and they have filed a bail petition before the concerned Magistrate and bail was also granted to them with a condition that they shall report before the respondent police every day until further orders.

3. This Court has also ordered notice to the accused/second respondent in

all the petitions to hear them regarding the allegations levelled in this petition. Though notice was served and they have not come forward to contest the matter. Hence, their names were printed in the cause list, inspite of the same none appeared on behalf of the accused/second respondent in all the petitions.

4. I have heard the learned Government Advocate in this regard who

submitted that after granting bail to the accused/second respondent in all the petitions they have not complied with the conditions and further submitted A5 who the second respondent in Crl.O.P.No.7092 of 2025 alone complied with the condition and others have not complied.. Hence, the petitioner has come forward with the present petition seeking cancellation of bail.

5. I have gone through order passed by the concerned Jurisdictional

Magistrate and one of the condition is that the accused/second respondent in all the petitions shall report before the police every day until further orders. Since the amount involved is nearly about 1.5 crores only 40.91 lakhs alone was recovered and since there is a clear violation of the bail condition granted by the Magistrate Court, I am of the view that it would be appropriate to cancel the bail granted to the respective bail petitioners/accused in all the above Criminal Original Petitions except the second respondent in Crl.O.P.No.7092 of 2025, as he has complied with the bail condition and appeared before the respondent police.

6. In view of the above facts, this Court is inclined to dismiss the petition in Crl.O.P.No.7092 of 2025 and all other original petitions ,are allowed. 20-01-2026 Index:Yes/No
