.....terminal benefit. for getting terminal benefits, the petitioner filed a writ petition in w.p.no.9261 of 2019. this court, by its order dated 28.11.2022 directed the 4th respondent to take appropriate action to settle the terminal and pensionary benefits of the petitioner hence, a portion of the terminal benefit was settled in favour of the petitioner and the balance amount was not settled thereby, the petitioner repeatedly made a representation. no order was passed hence, the present writ petition is filed. page2 of 44. per contra, the learned special government pleader appearing for therespondents would submit that already show cause notice was issued in the year 2025 however, till date, no reply was received from the 3 rd respondent. hence, suitable action will be taken in terms of the tamil nadu private school regulation act and appropriate order will be passed.5. in view of the above, there shall be a direction to the 1 st and 2ndrespondents to conduct a enquiry in between the petitioner and the 3 rd respondent and take suitable action, if the 3rd respondent failed to forward the necessary documents and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.6. this writ petition is disposed of with the above terms. no costs. index: yes/nospeaking/non-speaking orderneutral citation: yes/no kkn page3 of 4m.dhandapani, j.kkn to page4 of 4

ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the 1st respondent to release the pending retirement benefits standing to the credit of the petitioner within a time frame as fixed by this Court pursuant to the petitioner’s representation dated 01.11.2025.

2. With the consent of the learned counsel appearing on either side, this Writ Petition is taken up for disposal at the admission stage.

3. The learned counsel appearing for the petitioner would submit that the

petitioner was appointed as a Teacher in the 3 rd respondent School and subsequently, promoted as Head Master with effect from 01.06.2009 and retired from his service on 30.11.2015. However, the 3rd respondent has not permitted the petitioner to retire from service and also did not produce any documents to the statutory authority namely, 1st and 2nd respondents for settlement of the terminal benefit. For getting terminal benefits, the petitioner filed a writ petition in W.P.No.9261 of 2019. This Court, by its order dated 28.11.2022 directed the 4th respondent to take appropriate action to settle the terminal and pensionary benefits of the petitioner hence, a portion of the terminal benefit was settled in favour of the petitioner and the balance amount was not settled thereby, the petitioner repeatedly made a representation. No order was passed hence, the present writ petition is filed. Page2 of 4

4. Per contra, the learned Special Government Pleader appearing for the

respondents would submit that already show cause notice was issued in the year 2025 however, till date, no reply was received from the 3 rd respondent. Hence, suitable action will be taken in terms of the Tamil Nadu Private School Regulation Act and appropriate order will be passed.

5. In view of the above, there shall be a direction to the 1 st and 2nd

respondents to conduct a enquiry in between the petitioner and the 3 rd respondent and take suitable action, if the 3rd respondent failed to forward the necessary documents and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.

6. This Writ Petition is disposed of with the above terms. No costs. Index: Yes/No
