ORDER

This Writ Petition has been filed for a mandamus directing the 2nd respondent to disconnect the electricity supply in number 028- 023 -20 provided to the 3rd respondent temple situated at S.No.1111 / 2 B1A located at Annai Sathiya Nagar, Moolakadai, Madavaram, Chennai- 600 110.

2. The learned counsel appearing for the petitioner would submit that the

3rd respondent had illegally built a temple in the petitioner’s land and also obtained electricity connection therefore, the petitioner has given a representation to disconnect the electricity connection provided to the 3 rd respondent Temple. Since the same has not been considered, the petitioner is before this Court.

3. The learned counsel appearing for the Official respondents would

submit that subsequent to the petitioner’s representation, the respondents provided sufficient opportunity to the petitioner to provide document relating to the subject property but, the petitioner failed to provide any documents therefore, the respondents are not in a position to pass any orders.

4. Heard the learned counsel appearing for the petitioner as well as the respondents. Page2 of 4

5. Admittedly, upon representation made by the petitioner, the

respondents called upon the petitioner to provide relevant documents regarding the subject property. Since the petitioner failed to provide the same, the respondents were unable to pass any further orders. That part, in the present case, unless otherwise the title is established before the appropriate Court of law, the prayer sought for in the writ petition cannot be granted. Once the petitioner established his title through the appropriate Court thereafter, he can approach the official respondents for the purpose of disconnection or changing the name of the electricity connection.

6. In such view of the matter, this Writ Petition is devoid of merits and

the same is accordingly, dismissed. However, liberty is granted to the petitioner to approach the Civil Court for work out his remedy, subject to satisfaction of the limitation. No costs. Index: Yes/No
