(Judgement was made by N.SATHISH KUMAR, J.) Challenge has been made in this appeal to the exparte decree dated 08.11.2017 passed in O.S.No.300 of 2016 on the file of the learned III Additional District and Sessions Judge, Dharapurram.

2. The learned counsel for the appellants and the learned counsel for the

respondents submitted that the very exparte decree itself has been set aside by the Trial Court in I.A.No.25 of 2022 in O.S.No.300 of 2016 by order dated 17.03.2023, therefore, nothing survives in the appeal. Copy of the order dated 17.03.2023 is also placed before this Court.

3. Such view of the matter, nothing survives for adjudication in this

appeal and this appeal accordingly stands dismissed as infructuous. No costs. Consequently, connected miscellaneous petition stands closed. [N.S.K.J] [R.S.V.J] 02.01.2026 dhk Index:Yes/No
