ORDER

This application has been filed by the applicants/plaintiffs seeking to grant leave to sue against the respondent / defendant in respect of Item Nos.2 to 18 of the schedule properties are situated outside the jurisdiction of this Court.

2. According to the applicants, they are the plaintiffs in the main suit

and filed the suit for the relief of partition and separate possession. The Item No.1 of the schedule property is situated within the jurisdiction of this Court and Item Nos.2 to 18 of the schedule properties are situated outside the jurisdiction of this Court and a substantial part of the cause of action has arisen within the jurisdiction of this Court and the suit can be instituted before this Court.

3. This Court heard petitioner side and perused the records.

4. Considering the reasons stated in the affidavit that the Item No.1

of the schedule property is situated within the jurisdiction of this Court and Item Nos.2 to 18 of the schedule properties are situated outside the jurisdiction of this Court and the facts and circumstances of the case, this court is inclined to allow this application and therefore, leave is granted as prayed for.
