ORDER
(Order of the Court was made by R.SURESH KUMAR, J.) Prayer sought herein is for a writ of mandamus, to direct the respondent to dispose of the petitioner's statutory appeal filed under Section 19 of the Madras High Court Service Rules dated 15.07.2024.
2. Against the order of dismissal, the petitioner has preferred
a statutory appeal before the Appellate Authority, that is the respondent herein, on 15.07.2024. However, the said appeal is yet to be disposed and still, it is pending with the respondent Appellate Authority.
3. Therefore, seeking a mandamus from this Court to give
directions to the respondent to dispose of the appeal on merits at the earliest point of time, since the present writ petition has been filed, having heard Mr.J.Nagarajan, learned counsel for the petitioner as well as Mr.J.Chandran Sundar Sashikumar, learned counsel for the respondent, this Court is inclined to pass the following orders:-
(i) That there shall be a direction to the
respondent to decide the appeal dated 15.07.2024 filed by the petitioner, on merits and in accordance with law, and dispose it of within a period of three months from the date of receipt of a copy of this order.
4. Accordingly, this writ petition is disposed of. However, there shall be no order as to costs. (R.S.K., J.) (N.S., J.)
