Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 1st respondent to consider the joint Objection dated 07.01.2026 given by the Villagers of Eraiyur, before granting approval to the land in Survey No.62/2 measuring an extent of 2.38.0 hectares in Eraiyur Village classified as Kallanguthu Poramboke, for assignment of patta to the poor people and to change the place to the nearby alternate Natham poromboke land comprised in Survey No 240 or any other land, within the Eraiyur village.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This petition is filed seeking mandamus to consider the joint objection dated 07.01.2026 given by the Villagers of Eraiyur Village against the proposal for assignment of patta to poor people and to change the place to nearby alternate Natham poramboke land comprised in S.No.240 or any other land within the Eraiyur village.

2. No material was put forth to the notice of the Court to show

that before making allotment of land to poor persons residing in the area, objection is required to be invited. Petitioner has no right to claim that objection of the villagers should be decided.

3. Mandamus, therefore, cannot be issued. We leave it open for the authorities to decide the issue of feasibility on the materials available with them.
