Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 1 and 2 to grant patta to the petitioner for the writ property at Coimbatore Registration District, Sulur Sub Registration district, Sulur Taluk, Kannampalayam Village, Sarvamatha Colony, S.F.No.307/2 which is an extent of 3 cents with house bearing HSD Patta No.1240/83-84 Land Part-6 bearing D.No.12/32 on the basis of representation to respondents 1 and 2 dated 20.03.2025 and 28.04.2025 with in time as stipulated by this Court.

ORDER

This Writ Petition has been filed to direct the respondents to grant patta to the petitioner for the property morefully described in the prayer to this writ petition, based on the petitioner’s representations, dated 20.03.2025 and 28.04.2025, within a time frame to be fixed by this Court.

2. The petitioner claims that he is entitled for house site patta for

the property morefully described in the prayer to this writ petition. He has also filed supporting documents. He had given representations on 20.03.2025 and 28.04.2025 to the respondents seeking for issuance of patta in his name. Since the same was not considered, the petitioner has filed this writ petition.

3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents. Page No.2 of 6

4. No prejudice would be caused to the respondents, if the

petitioner’s representations seeking for issuance of patta is considered on merits and in accordance with law, within a time frame to be fixed by this Court, after hearing the objections, if any, from the neighbouring land owners as well as any third party as they deem fit.

5. This Court is not expressing any opinion on the merits of the petitioner’s representations.

6. Since the petitioner had not submitted an online application

with the 2nd respondent, the petitioner will have to submit a fresh online application with the 2nd respondent to enable the 2nd respondent to consider the said application on merits and in accordance with law.

7. For the foregoing reasons, this Court directs the petitioner to

submit a fresh online application with the 2 nd respondent seeking for issuance of patta in his name for the property morefully described in the prayer to this writ petition, within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of the said online application Page No.3 of 6

within the stipulated time, the 2 nd respondent shall pass final orders on merits and in accordance with law, on the petitioner’s application seeking for issuance of patta in the name of the petitioner for the property morefully described in the prayer to this writ petition, after giving due consideration to the supporting documents filed by the petitioner and after hearing the objections, if any, from the neighbouring land owners as well as any other third party, whom the 2nd respondent deems it fit to enquire, within a period of twelve (12) weeks thereafter.
