ORDER

Asserting title under sale deed dated 12.06.2006 in favour of the petitioner and his brother represented by the mother and natural guardian Saroja, the petitioner executed a settlement deed in favour of his sister. Upon being presented for registration, the registering officer did not take any action in relation thereto. Hence this writ petition.

2. Ms.Akila Rajendran, learned Government Advocate, accepts

notice for the sole respondent. She submits that the registering officer will either register the document or issue a speaking order of refusal within two weeks from the date of presentation or re- presentation, as the case may be.

3. The petitioner relies on sale deed dated 12.06.2006

bearing Document No.777 of 2006. Prima facie said sale deed is in favour of the petitoner and his brother, Radhakrishnan. Therefore, the registering officer should issue notice to Radhakrishnan before taking a decision.

4. For reasons aforesaid, this writ petition is disposed of on the following terms: 4.1 The petitioner is permitted to re-present the gift/settlement deed within two weeks from the date of receipt of a copy of this order; 4.2 Within thirty days therefrom, after issuing notice to Radhakrishnan, the registering officer shall either register the document or issue a speaking

order of refusal under Section 71 of the Registration
