.....months, as well as refund the rs.49,237/- in bpsc paid by the petitioner for august 2023.”2. the case of the petitioner is that they are operating 21 windmillsand one solar generator under the group captive scheme for consumption at its manufacturing plant. the petitioner had entered into energy wheeling agreements with banking facilities for the generators with the respondents and other electricity distribution circles under the control of the 1st respondent, in accordance with the norms and regulations prevailing in the state of tamil nadu.3. the petitioner has three ht service connection numbers, viz.,htsc nos. 049094370460, 049094370523 and 049094370536, connected to the 3rd respondent (namakkal edc), and had consumed a total of 78,82,520 units during august 2023. during the said period, the petitioner had generated 99,98,643 units, which, after accounting for time of day(tod) loss, amounted to 94,14,710 units.4. the petitioner would submit that the excess units generated duringthe peak season (for wind and solar generators) are maintained in the petitioner’s banking account and are adjusted in accordance with various orders issued by the tamil nadu electricity regulatory commission (tnerc). the standard practice of adjustment, as codified under the energy wheeling agreements and the tariff orders prevailing in the state, isthat the monthly consumption is adjusted against the monthly generation, and the balance units are credited to the banking account, which may be adjusted during the lean season of generation, subject to payment of applicable banking charges.5. the petitioner would further submit that, as on august 2023, it hadan opening balance of 94,14,710 units in its banking account. however, while entering the generation details on the tneb portal, the petitioner’s employee inadvertently entered an incorrect value with respect to the units to be adjusted from the banking account. as a result, the petitioner had incurred a loss of 2,25,642.....

Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, to direct the Respondents 1 to 4 to act in furtherance of the communication dated 09.09.2023 and rework the generation, banking and adjustment statements for the wind year commencing April 2023 to march 2024, reverse the incorrect levy of banking charges for the month of August 2023 constituting 2,25,642 units, and adjust the same against the current consumption bills of the Petitioner in HTSC Nos. 049094370460 for March 2024 or subsequent months, as well as refund the Rs.49,237/- in BPSC paid by the Petitioner for August 2023. ORDER

This writ petition has been filed for the following relief:- “to direct the Respondents 1 to 4 to act in furtherance of the communication dated 09.09.2023 and rework the generation, banking and adjustment statements for the wind year commencing April 2023 to march 2024, reverse the incorrect levy of banking charges for the month of August 2023 constituting 2,25,642 units, and adjust the same against the current consumption bills of the Petitioner in HTSC Nos. 049094370460 for March 2024 or subsequent months, as well as refund the Rs.49,237/- in BPSC paid by the Petitioner for August 2023.”

2. The case of the petitioner is that they are operating 21 windmills

and one solar generator under the Group Captive Scheme for consumption at its manufacturing plant. The petitioner had entered into energy wheeling agreements with banking facilities for the generators with the respondents and other Electricity Distribution Circles under the control of the 1st respondent, in accordance with the norms and regulations prevailing in the State of Tamil Nadu.

3. The petitioner has three HT Service Connection Numbers, viz.,

HTSC Nos. 049094370460, 049094370523 and 049094370536, connected to the 3rd respondent (Namakkal EDC), and had consumed a total of 78,82,520 units during August 2023. During the said period, the petitioner had generated 99,98,643 units, which, after accounting for Time of Day

(TOD) loss, amounted to 94,14,710 units.

4. The petitioner would submit that the excess units generated during

the peak season (for wind and solar generators) are maintained in the petitioner’s banking account and are adjusted in accordance with various orders issued by the Tamil Nadu Electricity Regulatory Commission (TNERC). The standard practice of adjustment, as codified under the energy wheeling agreements and the tariff orders prevailing in the State, is

that the monthly consumption is adjusted against the monthly generation, and the balance units are credited to the banking account, which may be adjusted during the lean season of generation, subject to payment of applicable banking charges.

5. The petitioner would further submit that, as on August 2023, it had

an opening balance of 94,14,710 units in its banking account. However, while entering the generation details on the TNEB portal, the petitioner’s employee inadvertently entered an incorrect value with respect to the units to be adjusted from the banking account. As a result, the petitioner had incurred a loss of 2,25,642 units.

6. Thereafter, on 09.09.2023, the petitioner had submitted a

representation explaining the issue and requested the respondents to revise the current consumption bill for the month of August 2023 and to restore 2,25,642 units to its banking account. Though assurances were given by the 1st respondent that the excess units would be adjusted, the same has not been done to date. Hence, the present Writ Petition.

7. Heard the learned counsel on either side and perused the records.

8. Considering the facts and circumstances of the case and taking

note of the assurance given by the 1st respondent, the respondents are directed to consider the petitioner’s request letter dated 09.09.2023 and pass appropriate orders thereon, on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this

order.
