.....dr.d.murugan ... appellantversus1. g.vijayan 2.m.devika ... respondents [2nd respondent was given up by the plaintiff in the lower court] for appellant : mr.s.vijayaraghavan for respondent : ms.k.m.valsala kumari for r1 mr.babu rangasamy for r2order(order of the court was made by n.sathish kumar, j.) this court while disposing of the above appeal on 05.01.2026 directed the appellant / first defendant to pay a sum of rs.10,00,000/- to thefirst respondent / plaintiff in addition to the amount already paid, within a period of eight weeks from the said date. it was also directed that till the payment of said amount, there shall be a charge over the property for that amount and the moment the entire amount is paid, the charge shall stand released automatically.2. now it is the grievance of the first defendant / appellant that he senta demand draft bearing no.501991 dated 28.01.2026 drawn on indian bank, bargur branch by registered post, but the first respondent/plaintiff without encashing the demand draft, returned the same to the appellant’s counsel. a copy of the returned cover has also been placed before this court.3. the learned counsel for first respondent/plaintiff would submit that since the plaintiff has returned the demand draft, the appellant/first defendant may be directed to deposit the amount before the trial court.4. in such view of the matter, the appellant shall deposit the amount ofrs.10,00,000/- [rupees ten lakhs only] before the principal district judge, krishnagiri to the credit of o.s.no.39 of 2012 within a period of two weeks from today i.e., on or before 09.03.2026. on such deposit, the charge on the property shall stand released automatically. the principal district judge, krishnagiri is directed to deposit the amount in an interest bearing deposit in any one of the nationalized bank. it is for the first respondent/plaintiff to withdraw the same by filing an appropriate application. ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) This Court while disposing of the above appeal on 05.01.2026 directed the appellant / first defendant to pay a sum of Rs.10,00,000/- to the

first respondent / plaintiff in addition to the amount already paid, within a period of eight weeks from the said date. It was also directed that till the payment of said amount, there shall be a charge over the property for that amount and the moment the entire amount is paid, the charge shall stand released automatically.

2. Now it is the grievance of the first defendant / appellant that he sent

a Demand Draft bearing No.501991 dated 28.01.2026 drawn on Indian Bank, Bargur Branch by Registered Post, but the first respondent/plaintiff without encashing the Demand Draft, returned the same to the appellant’s counsel. A copy of the returned cover has also been placed before this Court.

3. The learned counsel for first respondent/plaintiff would submit that since the plaintiff has returned the Demand Draft, the appellant/first defendant may be directed to deposit the amount before the trial Court.

4. In such view of the matter, the appellant shall deposit the amount of

Rs.10,00,000/- [Rupees Ten Lakhs Only] before the Principal District Judge, Krishnagiri to the credit of O.S.No.39 of 2012 within a period of two weeks from today i.e., on or before 09.03.2026. On such deposit, the charge on the property shall stand released automatically. The Principal District Judge, Krishnagiri is directed to deposit the amount in an interest bearing deposit in any one of the Nationalized Bank. It is for the first respondent/plaintiff to withdraw the same by filing an appropriate application.
