3cmp.no.68 of 2026 in crp.sr.no.213568 of 2025p.b.balaji, j.heard mrs. g. devi, learned counsel for the petitioner.2. the petitioner claims to be a tenant underthe first respondent and would submit that earlier proceedings before the learned rent controller had culminated in a compromise. however, behind the back of the petitioner, the first respondent has initiated eviction proceedings in rltop no.4 of 2025 against the husband of the petitioner, who is aged about 86 years, and has obtained an ex parte decree. the petitioner therefore seeks leave to challenge the orders passed in the execution proceedings arising out of the decree in rltop no.4 of 2025.3. in the light of the above submissions andupon perusal of the affidavit filed in support of this petition, as well as the reasons assigned therein, this court is of the view that the petitioner has made out a prima facie case for grant of leave to challenge the orders passed in the execution proceedings arising out of the decree in rltop no.4 of 2025. accordingly, leave is granted as prayed for.05.01.2026 kv note: registry is directed to list the dispense with the petition on 06.01.2025. https://www.mhc.tn.gov.in/judis

Heard Mrs. G. Devi, learned counsel for the petitioner.

2. The petitioner claims to be a tenant under

the first respondent and would submit that earlier proceedings before the learned Rent Controller had culminated in a compromise. However, behind the back of the petitioner, the first respondent has initiated eviction proceedings in RLTOP No.4 of 2025 against the husband of the petitioner, who is aged about 86 years, and has obtained an ex parte decree. The petitioner therefore seeks leave to challenge the orders passed in the execution proceedings arising out of the decree in RLTOP No.4 of 2025.

3. In the light of the above submissions and

upon perusal of the affidavit filed in support of this petition, as well as the reasons assigned therein, this Court is of the view that the petitioner has made out a prima facie case for grant of leave to challenge the orders passed in the execution proceedings arising out of the decree in RLTOP No.4 of 2025. Accordingly, leave is granted as prayed for.
