This is an application seeking pre-arrest bail filed under Section 438 of the Code of Criminal Procedure, 1973.

2. Learned Public Prosecutor upon instructions submitted that no crime has been registered against the petitioner before the Kulathupuzha Police Station, Kollam District.

3. In view of the above submission, the apprehension of arrest

of the petitioner does not subsist. Hence, this bail application is closed. However, in the event of petitioner being arrayed as accused, necessarily the procedure contemplated under Section 41A of the Cr.PC shall be complied with. BECHU KURIAN THOMAS JUDGE jm/
