JUDGMENT

The learned counsel for the petitioner - Sri.Shibin K.F. confined his plea on behalf of his client, that respondents 1 to 4 be directed to issue them a report of the new Committee, constituted pursuant to Ext.P5 interim order of this Court, as well as the decision on Ext.P1 Appeal, as expeditiously as is possible, because they intend to challenge the same, as also the consequent grant of Letter of Intent

(LOI) by the 3rd respondent - Indian Oil Corporation Ltd., to the 5 th respondent.

2. Sri.M.Gopikrishnan Nambiar - learned Standing Counsel for

the Indian Oil Corporation, submitted that the afore documents can be made over to the petitioner without any delay; but requested that this Court may not enter into the merits of any of his contentions in this writ petition, because they are all untenable.

3. Sri.C.K.Karunakaran - learned counsel appearing for the 5th

respondent, also submitted that the allegations of the petitioner made against his client are extremely mischievous and intended only to tarnish them and nothing more.

4. Even though I have recorded the submissions of

Sri.C.K.Karunakaran as afore, the fact remains that this Court need WP(C) NO. 29812 OF 2023 3 not enter into the merits of any of the rival contentions because, it is for the petitioner to invoke appropriate remedies, if they are interested in challenging the LOI already issued or to be issued to the 5th respondent. In the afore circumstances, I allow this writ petition and direct the 1st respondent - Tender Inviting Authority, to make available to the petitioner the report of the Committee and a copy of the decision taken on Ext.P1 appeal, as and when it is issued. The report as afore shall be made available to the petitioner within a period of two weeks; while the decision to be taken on Ext.P1 appeal, within a period of two weeks from the date on which it is issued. Needless to say, all contentions of the rival parties are left open, to be pursued and impelled by them in future, as they may be advised.
