JUDGMENT

Petitioner is the 4th accused in S.C.No.340/2019 on the files of the Assistant Sessions Court, Alappuzha. Due to non appearance of the petitioner, a non bailable warrant has been issued, and petitioner apprehends that, on his appearance, the Trial Court may remand him before consideration of the application for recall of warrant and bail.

2. Having heard the learned counsel for the petitioner as well as

the learned Public Prosecutor, I am satisfied that, directions can be issued to consider the applications for bail and for recall of warrant on the same day of filing, provided petitioner appears on a particular date.

3. In the above circumstances, there will be a direction to the

Assistant Sessions Court, Alappuzha, in S.C. No.340/2019 to consider application for recall of warrant and for grant of bail on the same day itself, provided petitioner appears and files such an application on or before 04.09.2023.
