ORDER
1. Today when the matter came up for consideration,
the learned Public Prosecutor upon instruction submitted that, as of now the petitioner has not been made as an accused. But, as the petitioner provided shelter to the first accused, for sometime he needs to be questioned.
2. Since the petitioner is not made as an accused, I do
not find any necessity to pass orders in this case and accordingly the application is closed. However, it is clarified that in case the presence of the petitioner is required, the same can be procured by the investigating officer after issuing notice with a reasonable time to appear before the investigating officer.
