ORDER
Dated this the 22nd day of August, 2023 The petitioner has approached this Court as he apprehends arrest in connection with the investigation in OR.No.12/2023 of Excise Enforcement and Anti Narcotic Special Squad, Malappuram. The crime was registered for the offences punishable under Sections 20(b)(ii)A and 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Today, when the matter came up for consideration, the
learned Public Prosecutor upon instruction submitted that, the petitioner has not been arrayed as the accused in the aforesaid case. But, he was issued with a notice under Section 41A of Cr PC, as his statement is to be recorded in connection with the investigation of the said case. Since it is reported that the petitioner has not arrayed as an accused, no orders in this application are necessary. Therefore, this application is closed accordingly with above observations.
