[WP(C) Nos.4007/2013, 9587/2013] These two writ petitions are connected and therefore, I am disposing of these two writ petitions by a common judgment. The prayers in these writ petitions are extracted hereinbelow: “W.P.(C).No.4007 of 2013 A) Issue a writ of mandamus or other appropriate writ or

order directing respondents 2 to 7 to restrain the 1 st

respondent from drawing water from the pond constructed in the property in Re-Sy.No.50/12-2 of Madappally Village. B) Issue a writ of mandamus, or any other appropriate writ or order directing respondents 2 to 5 to take immediate action on Exhibits P-2 to P-5 and

C) Issue a writ of mandamus, or any other appropriate writ or order directing respondents 3 and 4 to act upon Exhibit P-6. D) issue such other writ, order or direction as are deemed just and proper on the facts and circumstances of the case. VI. Interim relief. W.P.(C).No.9587 of 2013 i) Issue a writ in the nature of mandamus commanding

respondents 1 to 5 and 7 to take steps forthwith to stop pumping of water from the pond situated in the property of the 6th respondent in Re.Sy.No.50/12-2 of Madappally Village. ii) issue a writ of mandamus or other appropriate writ,

order or direction directing the 3rd respondent to

conduct a detailed hydro geological study with respect to the availability of ground water and its extraction in Madappally Grama Panchayat area where the pond of the 6th respondent is situated and to submit a report before this Hon’ble Court; iii) grant such other and further reliefs as this Hon’ble Court may deem fit to grant in the facts and circumstances of the case.”

These writ petitions are pending before this Court from 2013 onwards. The main grievance of the petitioners is that there is indiscriminate extraction of water from a pond for commercial purpose, which is affecting the ecological system in that area. Since there is no interim order in these writ petitions, these writ petitions need not be retained indefinitely. If there is any surviving grievance to the petitioners, petitioners are free to approach the District Collector - Kottayam with appropriate representation and if such a representation is received the District Collector will consider the same and take appropriate action in accordance with law after giving an opportunity of hearing to the petitioners and the other affected parties.
