This application is filed under Section 438 of the Code of Criminal Procedure seeking anticipatory bail.

2. Today, when the matter is taken up for consideration,

the learned Public Prosecutor submits that no crime has been registered against the petitioner till date. The learned Public Prosecutor has also made available a statement which reads as follows: “ After the registration of the case in Cr.No.282/23 u/s. 420 IPC & Sec.3 r/w 21(1)(2), 5 r/w 23 of the BUDS Act-2019 dated 08.05.2023, no petition has been received in Bedakam Police Station against the petitioners and no case registered against them. In such circumstances, this Bail Application is closed. It is made clear that if the presence of the petitioner is wanted in connection with this case, the Investigating Officer shall issue notice under Section 41A of Cr. P.C. if the alleged offence is punishable with an imprisonment of less than seven years.
