JUDGMENT

In these writ petitions petitioners challenges an amendment brought out to the Pharmacy Regulations Act, 2019 (Ext P4 in WP(C) No.15872/2021), not to consider M.Pharm (Pharmacy Practice) as a sufficient qualification for appointment as clinical pharamacist in hospitals.

2. Petitioners are candidates possessing M.Pharm (Pharmacy

Practice). When the matter was taken up for consideration the learned DSG pointed out on the strength of the counter affidavit filed on behalf of respondent Nos. 1 and 2, that in view of the several representation received from all over the country requesting to include M.Pharm (Pharmacy Practice) as also an eligible qualification for the post of Clinical Pharmacist, the matter was reviewed by the

council and placed the matter in the 357 th executive committee held

in January 2022 of the Council and it was decided to include M.Pharm (Pharmacy Practice) also as eligible qualification for the post of clinical pharamacist. Accordingly, the Pharmacy Council of India has issued a letter dated 01.02.2022 to State Governments/Union Territories and sought their comments and the time periods for going :6: through such comments was fixed as 02.05.2022 and that now the matter is under active consideration of the Government for issuing necessary gazette notification in this regard.

3. In view of the said stand taken by respondent Nos. 1 and 2

in their counter affidavit, the grievance raised by the petitioners is substantially redressed. What remains is only implementation of the decision of the Pharmacy Council which is reflected in paragraph 7 and 8 of the counter affidavit. Therefore the above writ petitions are disposed of with a direction to respondent Nos. 1 and 2 to implement their decision at the earliest, at any rate within an outer time limit of three months from the date of receipt of a copy of this judgment. With the above said direction, the writ petitions are disposed of.
