JUDGMENT
1. These writ petitions are filed challenging order of the Kerala
State Electricity Board Ltd., as also the notification issued for appointment to the post of Sub Engineer (Electrical). The contention of the petitioners is that the exclusion of the qualification of Diploma/ Degree in Electronics Engineering for appointment to the post of Sub Engineer (Electrical) is against Exhibit P5 regulations issued by the Central Electricity Authority and that such prescription of qualifications are illegal and unsustainable. It is contended that Exhibit P5 regulations specifically provide that Engineers or Supervisors engaged in operation and maintenance of transmission and distribution system shall hold Diploma in Electrical, Mechanical, Electronics and Instrumentation Engineering from a recognised institute or university. It is submitted that Diploma in Electronics Engineering was a recognised qualification for appointment to the post of Sub Engineer (Electrical). It is submitted that after the notification of Exhibit P5 regulations, the Board had taken appropriate steps to amend the qualifications, since the certificate in Electrical Engineering was not a sufficient qualification as provided in the regulations. However, while amending the qualifications, without any reason whatsoever, apart from deleting of qualification of Certificate in Electronics Engineering, the Board order also provided that a pass in three year regular/part-time Diploma in Electrical or Electrical & Electronics Engineering recognised by AICTE alone would be the basic qualification. It is stated that though candidates having higher qualification of the above technical qualification are also eligible to apply, the petitioners, who are Degree or Diploma holders in Electronics Engineering are disabled from applying in pursuance to the notifications issued for appointment to the post of Sub Engineer (Electrical), which is against the provisions of the Regulations.
2. The learned counsel for the petitioner places reliance on the
decisions of this Court in Kerala State Electricity Board Ltd v. Santhosh [2020 (4) KLT 429] as also the Apex Court in Muhammed A.A and others v. State of Kerala and others [2022 KHC 6199] to contend that the provisions of Exhibit P5 regulations are mandatory and that the Board cannot fix qualifications in violation of the said regulations. Relying on the decision of the Apex Court in Chief Manager, Punjab National Bank and another v. Anil Kumar Das [Civil Appeal No.362/2020], the learned counsel for the petitioner in W.P.(C).No.205 of 2022 would contend that fixation of qualification cannot be an arbitrary exercise and that there is absolutely no reason, whatsoever, stated in Exhibits P1 & P3 for excluding the qualification of Diploma or Degree in Electronics Engineering from the accepted qualifications and therefore such exclusion is bad in law.
3. A detailed counter affidavit has been placed on record by the
Board, wherein it is contended that all the aspects of the matter have been specifically considered by the appointing authority while fixing the qualifications. It is submitted in the counter affidavit as follows:-
“6.Being a distribution licensee, a transmission utility and generating company KSEB Ltd has an obligation to comply with the regulations issued by the Central Electricity Authority under section 177 of the Electricity Act 2003 namely CEA (Measures relating to safety and Electric Supply). The Sub-regulations 6(1) of the Regulation prescribe that the Engineers and supervisors appointed to operate or undertake maintenance of a thermal power generating station and a hydro power plant together with the associated sub-station shall hold diploma in engineering from a recognized institute or a degree in engineering from a University. Also Sub-regulations 7(1) of the Regulations prescribe that the Engineers and supervisors engaged in operation and maintenance of transmission and distribution systems shall hold diploma in electrical, mechanical, electronics and instrumentation engineering from a recognized institute or university. It is respectfully submitted that Electronics and Telecommunication Degree or Electronics and Telecommunication Diploma has not been prescribed as a qualification for Engineers or Supervisors in the said Regulations. 9.It is submitted that the Board has revised the qualifications of Sub engineer (Ele) under 30% quota in pursuance to the Exhibit P6 Government order dated 13.02.2019 with the concurrence of Kerala Public Service Commission with a view of taking suitable measures for the provisions relating to safety and electric supply as per Sub regulations 7(1) of the CEA Regulations 2010. 11.It is submitted that the syllabus prescribed for 3 year diploma
course in Electrical & Electronics Engineering covers 28 papers/Lab/Projects in Electrical Engineering out of the total 55 papers prescribed for the course. Copy of the same is produced here with and marked as Exhibit R2(c). Whereas the syllabus for diploma course in electronics and communication covers just one paper of electrical stream and that itself is a general topic out of the total 55 papers prescribed for the course. Copy of the same is produced herewith and marked as Exhibit R2(d). Hence it is very much clear that Electronics & Communication Engineering courses do not cover adequate topics in electrical engineering. 14.The CEA Regulations stipulate that the Engineers/Supervisor working in the power sector shall possess a Degree/Diploma in Electrical, Mechanical or Electronics & Instrumentation Engineering. Though Electrical Engineers are inevitable in any power system irrespective of the type of prime movers used for Generation, Mechanical/Electronics & lnstrumentation Engineering professionals find place mainly in Generating Stations which uses Nuclear/Thermal Energy. Since the power generation in KSEB Limited is almost fully Hydel, there is no specific role for Mechanical/Electronics & Instrumentation Engineers/ Diploma holders here. The Generation, Transmission & Distribution in KSEB Limited is entirely managed by Electrical Engineers/Diploma holders ever since the inception of KSEB Limited. 18.It is submitted that the qualification of Sub Engineer (Ele) in KSEB Limited was amended after several deliberations and in consultation with Power Sector experts, academician etc and with Kerala Public Service Commission with an intention to retain KSEB Limited as an effective power utility in the State to provide quality
power on demand, ensuing safety of its installation, employees and the public.”
4. The learned standing counsel for the Board in W.P.(C).No.205
of 2022 would also place reliance on a decision of the Apex Court in Maharashtra Public Service Commission through its Secretary v. Sandeep Shriram Warade and others [AIR 2019 SC 2154] to contend that the fixing of qualification is a matter which falls completely within the competence of the employer and a constitutional court cannot lay down conditions of eligibility much less delve into the issue with regard to desirability of qualifications or equivalence.
5. Having considered the contentions advanced on either side, I
notice that Exhibit P5 regulations provide the broad guidelines
with regard to qualifications to be possessed by the different grades of staff dealing with the generation and supply of electricity from the view point of safety. Regulations 6 and 7 read as follows:- “6. Safety measures for operation and maintenance of electric plants.(1)Engineers and supervisors appointed to operate or undertake maintenance of any part or whole of a thermal power generating station and a hydro power plant together with the associated sub-station shall hold diploma in Engineering from a recognized institute, or a degree in Engineering from a university.
(2) The Technicians to assist engineers or supervisors shall possess
a certificate in appropriate trade, preferably with a two years course from a Industrial Training institute recognized by the Central Government or the State Government.
(3) Engineers, supervisors and Technicians engaged for operation
and maintenance of electric plants should have successfully undergone the type of training as specified in Schedule-II. Provided that the existing employees shall have to undergo the training mentioned in sub-regulation (3) within three years from the date of coming into force of these regulations.
(4) The owner of every thermal power generating station and hydro
power plant together with their associated sub-station shall arrange for training of personnel engaged in the operation and maintenance of his generating station along with associated sub-station in his own institute or any other institute recognized by the Central Government or the State Government. Provided that separate training shall be given to the persons engaged in operation and maintenance of thermal power stations and hydro power stations including associated sub-stations.
7. Safety measures for operation and maintenance of
transmission, distribution systems. (1) Engineers or supervisors engaged in operation and maintenance of transmission and distribution systems shal] hold diploma in electrical, mechanical, dectronics and instrumentation Engineering from a recognized institute or university.
(2) The Technicians to assist engineers or supervisors shall possess
a certificate in appropriate trade, preferably with a nvo years course from a Industrial Training institute recognized by the Central Government or State Government.
(3) Engineers, supervisors and Technicians engaged for operation
and maintenance of transmission and distribution systems clectric plants should have successfully undergone the type of training as specified in Schedule-H. Provided that the existing employees shall have to undergo the training mentioned in sub-regulation (3) within three years from the date of coming into force of these regulations.
(4) Owner of every transmission or distribution system shall arrange
for training of their personnel engaged in the operation and maintenance of transmission and distribution system in his own institute or any other institute recognized by the Central Government or State Government.”
6. In Kerala State Electricity Board Ltd v. Santhosh [2020
(4) KLT 429] this Court had considered the validity of a Government Order granting relaxation to persons in the
service of the Board till the date of the said Government Order
from acquiring the qualifications as provided in the regulations. After considering the rival contentions, this Court found that the Government had the power to grant relaxations to existing employees from the rigour of the Rules. This Court found that safety regulations were framed in 2010 and the scheme under Section 131 was notified on 31.10.2013 by the Government. It was found that on a consideration of the provisions in Sections 131 and 133 of the 2003 Act and the regulations framed under Section 53 read with Section 177 of the Act, the said provisions cannot take away the protection granted to officers and employees through proviso to Section 133(2) of the 2003 Act. It was, therefore, found that officers and employees of the Board, as on the date of the scheme, that is, 31.10.2013, are entitled to the exemption which the Government is competent to grant. However, it was found that the grant of exemption from regulations 6 and 7 to all officers and employees as on the date of the order, that is. 13.2.2019 is untenable and the Government Order was set aside to that extent. The said decision was affirmed in S.L.P as well.
7. Therefore, it is apparent that Exhibit P5 regulations are binding on the Board. It is for the said reason that the Board had proceeded to amend the qualifications for the post of Sub Engineer (Electrical).
8. It is the specific case of the learned counsel appearing for the
respondents that it was after due deliberations and considering all relevant aspects of the matter and after due consultation with the Government and the PSC that the present qualifications were fixed. The Board contends that the nature of the duties of the post in question was specifically considered and it was decided that a Diploma in Electrical Engineering or Electrical and Electronics Engineering was the apt qualification for appointment as Sub Engineer (Electrical). I am of the opinion that the question with regard to the sufficiency of one qualification or the propriety in omitting another are matters which fall completely within the competence of the appointing authority and this Court exercising jurisdiction under Article 226 of the Constitution cannot delve into the reasons which prompted the prescription of the qualifications. I find that the Board has the power to fix the qualification of its employees provided that the qualifications are not below the general qualifications as provided in Exhibit P5 Regulation.
9. In the light of the pleadings placed on record, I am of the
opinion that the contentions raised by the petitioners that the omission of the qualification of Diploma in Electronics Engineering from the qualifications prescribed in BO(FTD) No.336/21 dated 6.5.2022 was a mistake cannot be accepted. In view of the fact that the Board has prescribed the qualifications of Diploma in Electrical Engineering or Diploma in Electrical and Electronics Engineering as the basic qualification for the post of Sub Engineer (Electrical), the prayers, as sought for in the writ petitions cannot be granted. The writ petitions fail and the same are accordingly dismissed.
