JUDGMENT
This writ petition is filed by the petitioner challenging Ext.P10
order passed by the Additional District Magistrate, Malappuram
District - the 2nd respondent, dated 06.02.2023, issued under the provisions of the Indian Arms Act, 1959. According to the petitioner, the 2nd respondent has not applied his mind in issuing the said order. It is further submitted that the 2nd respondent just adopted the report of the District Police Chief and has cancelled the license issued to the petitioner.
2. The matter was heard for some time, however, later the
learned Counsel for the petitioner submitted that petitioner would file an appeal before the statutory authority as per the Act, 1959 and the rules thereto, and a direction may be issued to consider the appeal within a time frame, after the filing of an appeal by the petitioner.
3. I have heard the learned Counsel for the petitioner Sri. Praveen Hariharan, and the learned Senior Government Pleader Smt. Rashmi K.M., and perused the pleadings and materials on record. -3-
4. In view of the request made by the petitioner to withdraw the
writ petition enabling him to prefer an appeal before the Land Revenue Commissioner, this writ petition is dismissed as withdrawn. I make it clear that if the petitioner is filing any appeal within 10 days from the date of receipt of a copy of this judgment, it shall be considered and finalized by the statutory appellate authority, within three months from the date of receipt of a copy of this judgment. Accordingly, the writ petition is dismissed as withdrawn.
