JUDGMENT

The original petition is filed to direct the Court of the Additional Munsiff, Kollam, to consider and dispose of O.S.No.478/2012 within a reasonable time period.

2. Pursuant to the order dated 16.01.2023, passed

by this Court, the learned Principal Munsiff (In-charge of Additional Munsiff), by communication dated 18.01.2023, has informed this Court that the suit is filed for declaration and consequential reliefs. The suit now stands posted for pre-trial steps to 03.02.2023, as a last chance. There was an order of stay passed by this Court in O.P(C) No.28/2019, which has been vacated. The learned Munsiff is holding additional charge of the court below and is holding sittings in two courts. The learned Munsiff requires 12 months’ time to dispose of the suit.

3. Heard, Sri.P.Pratheesh, the learned counsel

appearing for the petitioners. Even though service is complete on the respondent, there is no appearance for him.
