This Criminal Miscellaneous Case has been filed under Section 482 of the Code of Criminal Procedure, 1973, to quash Annexure A1 FIR in crime No.364/2023 of Kadavanthra Police Station, allleging commission of offences punishable under Sections 376(2), 323 and 342 of IPC and Sections 3 & 4 of the Protection of Children from Sexual Offences Act (Amended) 2012, 2019.
2. The learned counsel for the petitioner argued at length to convince this Court that no offence made out, prima
facie, from the prosecution records. Since he failed in this endevour and when this Court was about to dismiss this petition, holding that there are sufficient materials to go for trial, the learned counsel for the petitioner sought permission to withdraw this petition. Permission granted.
