The learned counsel for the petitioner submits that the bail application may be dismissed as withdrawn.

2. The application is filed under Sec.438 of the Code of Criminal Procedure, 1973, for an order of pre- arrest bail.

3. When the application came up for

consideration 20.05.2024 this Court directed the petitioner to surrender before the Investigating Officer within one week from 20.05.2024. However, it is reported that the petitioner has not surrendered before the Investigating Officer. Now he seeks liberty to withdraw the bail application. In the light of the above submission, the application is dismissed as withdrawn. It is made clear that the order dated 20.05.2024 is recalled.
