ORDER
The application is filed under Section 438 of the Code of Criminal Procedure, 1973, for an order of pre- arrest bail.
2. The petitioner apprehends arrest by the Kilikolloor Police Station, Kollam District, in Crime No. punishable under Sections 324 and 308 of the Indian Penal code.
3. Heard; Sri. Praveen H. Harikumar, the learned counsel appearing for the petitioner and Smt. Neema. T.V, the learned Senior Public Prosecutor appearing for the respondent.
4. The learned Public Prosecutor, on instructions, submitted that the petitioner has not been implicated as an accused till date in the above bail application, -:3:- but he is only a suspect. The investigation in the case is still in progress. The said submission is recorded. In the light of the above submission, the bail
application is closed. It is made clear that, if the presence of the petitioner is required by the Kilikolloor Police Station with regard to the allegations made in the bail application, he shall be issued with a notice under Section 41A of the Code, if the offence alleged against him is punishable for less than seven years.
