JUDGMENT

The above writ petition is filed with the following prayers: “i. Issue a Writ of Certiorari or other appropriate writs, orders or directions to call for the records leading to Exhibit P17 and to quash the same.

ii. Issue a writ of mandamus or other appropriate writs, orders or directions commanding the 1st respondent to rectify the anomaly contained in the survey records with respect to the petitioner's property in survey number 79/7 of Chalavara village by taking into consideration the contentions in Exhibits-P-9 and P-10 and also the report in Exhibit P-16 as expeditiously as possible at any rate within a timeframe to be fixed by this Honourable Court.

iii. Issue a writ to declare that Exhibit-P17 is vitiated by violation of principles of natural justice. iv. Render such other orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.” SIC

2. This writ petition is pending before this

Court from 2017 onwards. No interim order is passed in this case. The petitioner challenged Ext.P17 order. Admittedly the petitioner has got a right of appeal against Ext.P17. If that be the case, I think, this writ petition need not be retained here. Without expressing any opinion on merit, the petitioner can be allowed to challenge Ext.P17 by filing appeal before the appellate authority. Therefore, this writ petition is disposed of with the following directions:

2. If, such an appeal is received, the appellate
