JUDGMENT

The issue involved in all these cases concerns the sanction of additional Higher Secondary batches to the schools run by the petitioners. There are also consequential prayers. All these cases are hence being heard and disposed of together.

2. The immediate provocation for filing all these writ

petitions is the issuance of G.O.(MS)No.106/2023/G.Edn dated 27.07.2023, whereby the Government sanctioned 97 temporary additional batches during the academic year 2023-2024 in 97 schools in the Malabar area. W.P.(C).Nos.25519, 25468, 25718, 26257, 26770, 26890, 27694, 27755, 29693, and 33493 of 2023 have been filed with a prayer for a direction to sanction additional batches for the petitioner schools, to call for applications from the & con.cases -25- schools in the locality for sanctioning additional batches and to quash G.O.(MS)No.106/2023/G.Edn dated 27.07.2023 by which 97 additional batches were sanctioned. W.P.(C)Nos.27263, 27804, and 28920 of 2023 have been filed with the same prayers and with an additional request to consider and dispose of the representations filed by the petitioner schools seeking additional batches. W.P. (C)Nos.26182, 28604, 29830, 30202, 30460, 30704, 31664, 33861, and 38096 of 2023 have been filed with similar prayers, but the prayer to quash the Government Order sanctioning 97 additional batches to other schools is included only in W.P.(C)Nos.33861 and 38096 of 2023 and not in the others. W.P.(C)No.27190 of 2023 has been filed with the prayer for sanctioning additional batches and for a direction to consider the representation filed by the petitioner for that relief. Since the academic year 2023-2024 is already over, it will not be proper for this Court to interfere with the additional batches already granted as per the Government Order, as students have already joined the additional batches and completed their academic year. The only question being considered by this Court is whether the order Ext.P11 was issued following the law laid down by this Court in earlier writ petitions. & con.cases -26-

4. After abolishing the Pre-Degree Course and introducing

the 10 + 2 curriculum in the schools, during the academic year 1997-98, the exercise of processing applications for sanctioning Plus Two courses in schools began. Though the State Government had announced its policies in this regard in various Government Orders issued from time to time indicating the procedure that would be & con.cases -27- followed for identification of the High Schools where the Higher Secondary batches are to be allowed to be started, the State failed to adhere to its own laid down policies while sanctioning additional batches. In a batch of writ petitions filed in the year 2000, a Division Bench of this Court had held that though the procedure for screening the applications and identifying the schools for sanction of Plus Two courses had been laid down, the same was not followed. Finding manifest arbitrariness in sanctioning Plus Two courses, this Court had quashed the Government Orders issued in that regard (See Judgment dated 07.07.2000 in OP.No.17843/2000 and connected cases). This Court directed the State Government to follow the procedure laid down by it in the Government Orders within a specified time frame.

5. Even after the above judgment, no uniform principle was

adhered to in the subsequent years, by the various successive Governments. The Government issued G.O.(MS) No.185/13/G.Edn dated 11.06.2013, whereby it was decided to accord sanction for two batches of Higher Secondary Courses in 148 Grama Panchayats where there are no Higher Secondary Schools and 382 batches in 8 northern districts from Ernakulam to Kasargode. The said & con.cases -28- Government Order was also challenged in a batch of writ petitions. The writ petitions were allowed by a learned Single Judge quashing the Government orders as ultra vires the provisions of the Kerala Education Rules (KER).

6. The judgment of the learned Single Judge was reversed

by a Division Bench of this Court holding that the provisions of the KER will not apply to the sanctioning of Higher Secondary Courses in Higher Secondary Schools and that there was no material before the Court warranting interference with the policy decisions taken by the State Government. The Division Bench in its judgment in W.A.No.1341 of 2013, however, observed that after giving effect to the policy decision dated 11.06.2013, the Government should also consider the grant of Higher Secondary Courses in other areas where there was an educational need.

7. After the judgment of the Division Bench, a Cabinet

Committee was constituted with the Minister of Education as the Chairman. Another committee had been constituted with the Director of Higher Secondary Education as the Chairman. The recommendations made by the Director of Higher Secondary Education along with a list of schools for starting the plus two & con.cases -29- courses and for sanctioning additional batches were submitted on 19.05.2014 and the said report was accepted by the Cabinet Committee. However, at that stage, the Government issued G.O. (MS)No.86/14/G.Edn dated 24.05.2014 which indicated that the decision of the Government was not to sanction new Higher Secondary Schools during the academic year 2014-2015, but only to sanction additional batches throughout the entire State and to invite applications for the same. The reason for the decision appears to be that there would be unaffordable financial commitment if new Higher Secondary Schools were allowed. The Government Order dated 24.05.2014 was challenged by the Managements of some of the schools, before this Court, and a Division Bench of this Court quashed the Government Order dated 24.05.2014 finding that the Government did not have any material to support a deviation from its earlier policy decision stated in the Government Order dated 11.06.2013. Thereafter, the Cabinet again considered the matter on 16.07.2014. A sub-committee was constituted to go into the matter. Based on the recommendations of the Cabinet Sub-committee, that was accepted by the Council of Ministers, G.O.(MS)No.143/14/G.Edn dated 31.07.2014 was issued. The above Government Order was & con.cases -30- challenged in a batch of writ petitions.

8. A learned Single Judge of this Court heard the cases in

detail and took note of the events that took place from the academic year 1997-98 and the previous judgments of this Court on the subject, which have been narrated above. The judgment of the learned Single Judge, in the said cases, has been reported as Manager, St.Sebastian High School Thrissur District v. State of Kerala and others [2015 KHC 725]. After a detailed consideration of the entire issues involved, this Court issued specific directions that are to be followed while sanctioning Plus Two courses in schools. The Government accepted the above judgment. The directions issued by this Court were comprehensive and were to guide the Government while granting Higher Secondary Courses. One of the directions was that the Government should evolve and put in place suitable machinery to determine the educational need in each district in the State in the field of Higher Secondary Education which shall determine the educational need on an ongoing basis so that the educational need for any academic year is estimated at least a year in advance. There is a further direction to the State Government to periodically call for applications from the Educational & con.cases -31- Agencies in the districts concerned and take steps to sanction Higher Secondary Courses in such districts.

9. Though directions were issued as early as in 2015,

confusion continued in the matter of sanction of higher secondary batches. The issue again came up for consideration before this Court in Manager, Munniyoor HSS, Parakkadavu v. State of Kerala and others [2022 KHC 64]. There were two writ petitions before the Court and the prayers were for setting aside a Government

Order by which the request made by the petitioner therein for

sanction of additional higher secondary batches was declined by the Government. The contention of the petitioner before the Court was that the directions issued by this Court in St.Sebastian (supra) were not being followed by the Government. The Court took note of the fact that the petitioners before the Court were conducting a school in Munniyoor, which is an educationally, socially, and economically backward area and that about 2000 students were studying in the school. It was noticed that 750 students passed the SSLC examination during the previous academic year and there were only 4 plus one batches which can accommodate about 200 students. The Court considered the total number of students who & con.cases -32- had applied for the course in the Malappuram district and the total number of seats available in the district and found an acute shortage of seats in several local areas in Malappuram district. The Court found that once the educational need in an area is established, and the same is supported by the findings of a committee constituted by the Government itself, the Government cannot be heard to contend that the applications for additional batches shall not be considered until the Government decides in that regard. The Court held that the Government would be abdicating its constitutional duty of providing education to a citizen by taking such a stand. The Court directed the Government to sanction three additional batches for the school in question.

10. The judgment of the learned Single Judge was challenged in appeal before a Division Bench of this Court. The Division Bench disposed of the appeals by judgment in State of Kerala v. Sreelal

[2023 (1) KLT 319]. Paragraph Nos.13 and 14 of the judgment

read as follows:

“13. Before dealing with the Writ Petition filed by the Manager, it is necessary to remind ourselves the principles to be kept in mind while dealing with a Writ Petition of this nature. Every citizen has a right to education under the Constitution and the State is under an obligation to establish educational institutions so as to enable citizens to enjoy the

said right. The State may discharge the said obligation either through State owned educational institutions or through private educational institutions recognised and regulated by the State (See Mohini Jain v. State of Karnataka & Ors., 1992 (2) KLT OnLine 1040 (SC) = 1992 KHC 898). If the State is not able to discharge the said obligation for reasons beyond its control through the State owned educational institutions, no doubt, the State is certainly entitled to discharge the said obligation through State recognised and regulated educational institutions including aided institutions. It is necessary to clarify in this context that the obligation of the State as enshrined in the Constitution is only to take necessary steps to cater to the educational needs of the citizens within the limits of its economic capacity, and it cannot be said that in the matter of evolving a policy and in the matter implementing the policy so evolved, the Government cannot take note of the financial implications involved (See Unni Krishnan J.P. v. State of Andhra Pradesh (1993 (2) KLT OnLine 1113 (SC) = (1993) 1 SCC 645) and Modern School v. Union of India, (2004 (3) KLT SN 13 (C.No.17) SC =(2004) 5 SCC 583). Needless to say, what is expected from the Government is that there has to be a fair decision in the matter of discharging the said constitutional obligation.

14. It is seen that this Court has noticed in St.Sebastian's High

School, that there is no proper system in place in the State for assessment of educational need in the field of secondary education, and in the absence of a consistent and transparent policy, the allotment process of fresh and additional batches of higher secondary courses is always entangled in litigations. In the aforesaid circumstances, this Court issued the following directions to the Government in the matter of consideration of applications for the grant of higher secondary courses:

(i) The State Government shall evolve and put in place suitable machinery to determine the educational need in each district in the State in the field of higher secondary education;

(ii) The machinery to be set up by the State Government must & con.cases -34- be one that determines such educational need on an ongoing basis so that the educational need for any academic year is estimated at least a year in advance.

(iii) Based on the determination of educational need, the State

Government must periodically call for applications from educational agencies in the district concerned and take steps to sanction higher secondary courses in such districts.

(iv) The criteria evolved by the State Government for sanctioning higher secondary courses must, inter alia, take into account the socially, educationally and economically backward areas in each district.

(v) While considering applications in areas where an educational

need has been determined as existing, the State Government shall give preference to those applicants who have been recommended for the grant of higher secondary course in the past, either through Government Orders or through judgments of this Court, but were not sanctioned Higher Secondary Courses only because there was no policy decision then taken by the State Government to sanction Higher Secondary Courses in the State, or on account of the then Government facing financial constraints. Such cases would have to be considered favourably for a grant, subject to the applicant concerned complying with the infrastructural and other requirements mandated by the Kerala Education Act and Rules.

(vi) Insofar as I have directed that the State Government shall

call for applications, based on the perceived educational need determined in any area, before considering a grant of higher secondary course to any educational agency in the said area, it would be open to the petitioners herein to respond to any call for applications by the Government, as and when made, and the fact that they have preferred applications in the past or that any such application preferred has been rejected in the past shall be of no

& con.cases -35- relevance in a consideration by the State Government of the merit of the fresh applications so preferred by the petitioners.

(vii) The State Government shall endeavour to complete the

above exercise by 31.03.2016 for the next academic year and thereafter, sanction courses based on educational need by 31st March of every succeeding year so that no student is prejudicially affected in the pursuit of his higher secondary education in the State during the academic year 2016-17 or thereafter. It is seen that the Government has accepted the directions contained in the

judgment of this Court in St. Sebastian's High School, and issued Ext.P4

order on 05.04.2016 constituting Regional Level Committees covering two

Districts and a State Level Committee for assessment of the educational need of the State in the field of higher secondary education. It is directed in the said order that the Regional Level Committee shall furnish a report to the State Level Committee for the next academic year before 30th September every year and the State Level Committee shall scrutinize the report of the Regional Level Committees and submit a final report to the Government before 31st October every year. It was also stated in the said

order that the Government will examine the report of the State Level

Committee and take a decision for calling for applications to be set out in the detailed guidelines to be issued later and the entire exercise on the basis of the educational needs shall be completed within 31st March of the succeeding year. We have perused the judgment of this court in St. Sebastian's High School and we are in complete agreement with the said decision. Having regard to the directions issued by this Court in the said case and the directions issued in Ext.P4 order issued by the Government in compliance with the directions of this court, we are also of the view that if the directions issued by this Court in the said case and the directions in Ext.P4 order are complied with, the process of allotment of higher secondary courses in the State would be consistent and transparent conforming to the constitutional requirements.” (emphasis supplied)

11. After outlining the principles of law involved, the Division

Bench held that in a situation of this nature where the educational need and shortage of facilities are found, but the Government is not taking steps to cater to the need, the right of persons who run educational institutions being one traceable only to Article 19(1)(g) of the Constitution, all that can be sought for are directions to the Government to comply with the guidelines in this regard and nothing more. This Court considered the contention of the management of various schools, that the Government is obliged to grant additional batches of Higher Secondary Courses since the State Level Committee constituted by the Government pursuant to the directions issued by this Court in St.Sebastian (supra), had recommended the grant of additional batches of Higher Secondary Courses in the schools and held that the arguments cannot be accepted since the Government is not bound by the report of the State Level Committee and the purpose of the report is only to enable the Government to take a fair decision in the matter and to make the process of allotment of Higher Secondary Courses in various schools in the aided sector consistent and transparent. Regarding the arguments advanced that the State Government had & con.cases -37- not invited applications as directed by this Court in St.Sebastian (supra), the Division Bench held that the relief that can be prayed for in such situations is only for a direction to the Government to act upon the report of the State Level Committee and invite applications. The contention of the Government Pleader that sanctioning additional batches in a few Higher Secondary Schools that have made individual representations before the Government and which have approached this court challenging the decisions rejecting their representation will open up a Pandora’s Box, and the Government will be in a predicament in dealing with such applications in the light of directions of this Court in St.Sebastian (supra) was held to be justified. The Court held that in any areas where policy decisions involving financial implications are to be taken by the Government, the scope of judicial review is limited, that in such cases, the State is competent to frame a policy, and that unless a policy so framed is capricious or is in conflict with constitutional or statutory provisions, it is not open for the Court to interfere with such policy decisions. The Division Bench referred to the decision in M.P.Oil Extraction v. State of MP [1997 (7) SCC 592]. The Division Bench finally directed the Government to & con.cases -38- consider the acute shortage of facilities in the field of Higher Secondary Education in Malappuram District and decide how it would cater to the needs of the district.

12. The grievance of the petitioners in these writ petitions is

that even after the judgment of the Division Bench in Sreelal (supra), the Government has not considered the issue from the right perspective and taken a decision, and instead, went ahead with granting additional batches to 97 schools on a pick and choose basis without really ascertaining the educational need in the different areas. It is submitted that not only has the Government abdicated its duties as has been pointed out in the decisions referred supra, but the Government has also gone ahead to take arbitrary decisions as to choosing persons without any reference to the real need of the localities.

13. The role of this Court in these writ petitions is very

limited. The Division Bench in Sreelal (supra) has already pointed out the reliefs that can be claimed by educational institutions, in such matters. The Division Bench has unequivocally held that (i) individual requests for grant of additional higher secondary batches cannot be entertained; (ii) there cannot be a direction to grant & con.cases -39- additional Higher Secondary batches, merely for the reason that the State Level Committee had recommended so; (iii) where financial commitments are involved, the policy evolved by the State for sanction of Higher Secondary Course, cannot be interfered with, unless it is capricious or is in conflict with constitutional or statutory provisions ; (iv) that the process of allotment of Higher Secondary Courses in the State would be consistent, transparent and conforming to the constitutional requirements, if the directions of

this Court in St.Sebastian(supra), and, in the Government order

G.O.(MS)No.75/2016/G.Edn. dated 5.4.2016 are followed.

14. Coming to the present fact situation, I shall refer to the

facts borne out from the pleadings in WP(C)No.25519 of 2023

treating it as the lead case. The petitioner in WP(C)No.25519 of 2023 is the Manager of AR Nagar Higher Secondary School situated within the territorial limits of AR Nagar Grama Panchayat in Malappuram District. It is stated that more than 4000 students are studying in the school and 564 students passed SSLC examination during the previous academic year. The number of seats available for plus one course in the petitioner’s school was only 200 and it is submitted that more than 300 students will be deprived of the & con.cases -40- facilities in the school for pursuing their higher studies. This is the factual basis on which additional batches are requested. The petitioner submits that by Ext.P5 Government Order dated 27.07.2023, sanctioning 97 temporary batches, schools with sufficient batches have been allowed additional batches but schools that have educational needs have been avoided.

15. Ext.P5 says that the Director of General Education had,

vide letter dated 21.07.2023, recommended the sanction of 97 temporary plus one batches, to 97 Government schools and aided schools for the year 2023-2024 and the said recommendation is being accepted. It is seen from the order that online applications had been called for, for allotment of seats for plus one, and classes were started on 5th July after completing three levels of allotments. It is also noticed that more than 32433 students were awaiting admission without getting allotment. It is further stated that even though on the State level, there are more seats than applied for, in Palakkad and Malappuram Districts, the seats available are much less than the requirement. It is further stated that the Director of General Education had reported that in six districts from Palakkad to Kasargode, in various Taluks, there is a shortage of number of seats, & con.cases -41- which is the reason why 97 additional batches are recommended with an additional financial outlay of `15,71,40,000/-.

16. On 13.09.2023, this Court directed the petitioners as well

as the respondents in these cases to give details of the total number of students who have passed out SSLC from the petitioners' schools and the students who already got admission for Plus One in the petitioners’ school or other schools. The purpose was to ascertain the situation as to how many students who have passed out are waiting without being able to get admission for further studies. Affidavits were filed thereafter.

17. On 25.09.2023, this Court took note of the list made

available by the Government Pleader showing the students who have passed out SSLC from the schools in question and directed the respondents to give the number of seats available in those schools for the plus two classes along with such details that can give a clear idea about the requirement in each of the schools. Thereafter on 29.09.2023, this Court directed the Government Pleader to place on record an affidavit stating the actions that have been taken according to G.O.(MS)No.75/2016/G.Edn dated 05.04.2016 and how the educational need was identified in each of these cases. There & con.cases -42- was also a direction that the affidavit should clearly state about how the 97 additional batches were temporarily allowed and how the schools that were chosen for additional batches were identified. A detailed counter affidavit was filed by the Government Pleader thereafter.

18. It is stated in the counter affidavit that applications for

Plus One admission for the academic year were invited online on 02.06.2023 and the first-year classes commenced on 5 th July after completing the allotment of three phases. A total number of 417545 students applied in the main phase and 60488 students in the supplementary allotment out of which 361126 students got Plus One admission. It is stated that after the first supplementary allotment on 05.07.2023, 18005 vacancies existed in the merit quota, 10449 in the management quota, and 36203 in the unaided quota. It is submitted that there were 28454 vacancies in the schools and the total number of seats was found to be surplus at the State level. It is however admitted that, at the district level, there is a shortage of seats in Malappuram and Palakkad Districts. Since classes had already begun, there was limited time available with the Government to select the schools to cater to the needs of the & con.cases -43- students and the shortage of streams was identified by analysing the total number of applicants, the admitted students, the number of

students waiting for allotments, etc. It is submitted that these facts

are already available in the Central Allotment Portal. It is stated that the allotment of temporary batches in the Malabar area was a policy matter of the Government. It is further stated in the affidavit that the schools having infrastructure facilities were identified from the details submitted by the schools during the time of uploading the details in the Central Allotment Portal, and after verification of the infrastructure and taking an undertaking from the Principals of the schools, the decision was taken for allowing 97 additional batches. It is also submitted that apart from the infrastructure facilities, options submitted by the students who were waiting for admission were also considered. The counter affidavit further states that providing sufficient batches for admission of all the students who passed the 10th standard from a particular school, cannot be accepted as the yardstick for grant of additional batches and that such a course of action will not cater to the needs of the students. It is submitted that when it comes to the Higher Secondary stream, there are about 46 course combinations available, and the students can choose any & con.cases -44- of the 46 course combinations. All the 46 combinations will not be available in a single school. It is submitted that a student who passed out from a school will not seek admission in the same school necessarily and would go by their choice of combination of subjects. It is submitted that Higher Secondary education is not the only option available to the students who passed out from 10 th standard, they also have the option of VHSE, ITI, Polytechnic, etc.

19. It is admitted in the counter affidavit that the State Level

Committee did not submit any report of the Government for sanctioning additional batches as required in G.O. (MS)No.75/2016/G.Edn. during the previous year. However, the educational needs have been addressed by sanctioning temporary batches. It is also stated that 14 higher secondary batches having insufficient strength were shifted to Malappuram and other districts by Ext.R1(a) Government order dated 12.06.2023. The State relies on the judgment of the Division Bench in Sreelal (supra) to submit that the Government is not bound by the report submitted by the State Level Committee and the report can only enable the Government to take a fair decision in the matter.

20. Elaborate arguments were advanced by the counsel for

& con.cases -45- the petitioners and the Government Pleader. The counsel for the petitioners submitted that, admittedly, 30000 students were awaiting admissions when the impugned order sanctioning 97 batches was issued. It is submitted that seat availability is only in southern districts and there was no seat availability as far as northern districts are concerned. When more than 15000 seats were required in Malappuram District alone, only 53 temporary batches were granted in Malappuram which will be barely sufficient to meet the demand. These facts are borne out by the records which have been produced in this case by the Government itself. The Government meets the above arguments by stating that even though demands have been raised by the Managers of the schools, there are no complaints received from any students or their parents, stating that they could not get admission for want of sufficient seats. The above contention does not require any consideration. The students and parents will be busy trying to get admission to some school and will not be unnecessarily spending their time complaining to the State Government about the deficiency in the facilities for higher studies that are provided by the State Government. The counsel for the petitioners further submitted that the Government & con.cases -46- cannot deviate from the procedures which have already been laid down and considered in the judgment in St.Sebastian (supra) and any deviation from the procedure can only be by a legislative process. Admittedly, there has been no such legislative process. The Government cannot hence contend that they are not bound by the directions issued by this Court in St.Sebastian (supra). The Division Bench in Sreelal (supra) also affirmed the directions contained in the judgment in St.Sebastian (supra) and directed the Government to decide on the educational needs in Malappuram District. The judgment of the Division Bench in Sreelal (supra) as well as the judgment of the Single Judge which was impugned in the said appeal, clearly point out the fact situation in the district and the actual requirement. There is no case that the education need in the district has considerably reduced thereafter.

21. Even though this Court had directed the Government

Pleader to place on record an affidavit showing the steps that had been taken for identifying the education needs as per the directions contained in G.O.(MS)No.75/2016/G.Edn. dated 05.04.2016, the affidavits which have been filed do not indicate any such action that had been taken. On the other hand, the affidavits clearly show that & con.cases -47- no steps were taken to identify the education needs in the districts, especially in Palakkad and Malappuram. Paragraphs 3, 4, and 5 of the Government Order referred to above are extracted for reference;

“(iii) Based on the determination of educational need, the State Government must periodically call for applications from educational agencies in the district concerned and takes steps to sanction higher secondary courses in such districts.

(v) While considering applications in areas where an educational

need has been determined as existing, the State Government shall give preference to those applicants who have been recommended for the grant of higher secondary course in the past, either through Government Orders or through judgments of this Court, but were not sanctioned Higher Secondary Courses only because there was no policy decision then taken by the State Government to sanction Higher Secondary Courses in the State, or on account of the then Government facing financial constraints. Such cases would have to be considered favourably for a grant, subject to the applicant concerned complying with the infrastructural and other requirements mandated by the Kerala Education Act and Rules.”

22. The Government Order has been issued in compliance

with the directions contained in St.Sebastian (supra). This Court had directed to ascertain the education needs of the various districts on an ongoing basis. It is for that purpose that a Regional & con.cases -48- Level Committee and a State Level Committee have been

constituted as per the Government Order referred above. The order

specifically says that a report shall be furnished by the Regional Level Committee before the 30th of every year. There is no mention of such a report having been filed by the Regional Level Committee during the previous academic year. The order further says that the State Level Committee shall examine the report and take a decision for calling for applications from the educational institutions. Admittedly, this has also not been done. What is stated in the counter affidavit is that there was very limited time available with the Government to select the school to cater to the needs of the student community. The said excuse cannot be entertained since sufficient time has been identified by this Court in its judgment in St.Sebastian (supra), and in the Government order issued in compliance with the judgment. It is further stated that infrastructure facilities were identified based on information submitted during the uploading of details in the Central Allotment Process. The entire action was unilateral and the order issued sanctioning 97 additional batches had not been issued following the directions issued by this Court in St.Sebastian (supra) or Sreelal & con.cases -49- (supra). Neither has the procedure laid down by the Government itself in G.O.(MS)No.75/2016/G.Edn. dated 05.04.2016, has been followed. The sorry situation continues even after several judgments of this Court and orders issued by the Government on this behalf.

23. As already observed, since the academic year has ended,

no purpose will be served by quashing the Government Order

whereby 97 additional batches were allowed. However, positive directions are necessary which need to be strictly enforced. The results of the SSLC examination of the past academic year are already published and the process for admission to the Higher Secondary Course has started. We are once again at a stage where there will be a requirement for finding out the education needs in each district and different areas. There is no material available to state whether an assessment had been done by the Regional Level Committee during September last and whether any material had been placed before the State Level Committee for decision. In such circumstances, these writ petitions are disposed of with the following directions;

(i) The prayer for quashing GO(MS)No.106/2023/GEdn. dated 27.7.2023 is rejected. & con.cases -50-

(ii) The respondents shall call for a report from the Regional Level Committee and the State Level Committee regarding the education needs in the various districts within 15 days from today.

(iii) If education needs are identified in any of the areas

where the petitioners' schools are functioning, applications shall be sought from them as well as from others for either allowing higher secondary courses or granting additional batches.

(iv) No decision for sanctioning additional batches shall be

taken without strictly following the directions contained in G.O.(MS)No.75/2016/G.Edn. dated 05.04.2016, except regarding the date for assessment of need stated in the Government Order.
