The application is filed under Section 438 of the Code of Criminal Procedure, 1973, for an order of pre-arrest bail.

2. The petitioner is sole accused in Crime No.481/2021

of the Nallalam Police Station, Kozhikode registered against him for allegedly committing the offences punishable under Sections 406, 420 r/w Section 34 of the Indian Penal Code.

3. Heard; Sri.Firoz K.M, the learned counsel appearing for the petitioner and Sri.C.S.Hrithwik, the learned Senior Public Prosecutor appearing for the respondents.

4. The learned Public Prosecutor, on instructions,

submitted that the petitioner has been arrested on 22.1.2024 by the Kakkur Police in Crime No. 437/2022. In the light of the arrest of the petitioner in the connected crime, this bail application has become infructuous. The petitioner’s arrest would be recorded in the present crime also as contemplated under law. In the light of the above submission, the bail application is dismissed, by directing the Nallalam Police to record the arrest of the petitioner in Crime No.481/2021 as expeditiously as possible.
