ORAL ORDER

1. The petitioner is before this Court seeking the following prayer:
a. “Mandamus directing the Respondent no.2 to consider the representation dated 24.06.2016 of the petitioner and enforce the order bearing no. ZIPAN/ABHIVRUDDHI/GRAMAC/APPEAL /VIVA:90/2015- 16 dated 13.05.2016, passed by the respondent no.2 at vide Annexures-E adn B respectively. b. Mandamus directing the Respondent No.3 and 4 to give effect to the order bearing no. ZIPAN/ABHIVRUDDHI/GRAMAC/APPEAL dated Annexure-B. c. And grant such other relief as this Hon’ble Court may deem fit in the circumstances of the case.”
2. Heard Sri.Jagadish Patil, learned counsel for the petitioner and Smt.Girija S. Hiremath, learned HCGP for respondent No.1.
3. The petitioner is stated to have been appointed
pursuant to a notification issued by respondent No.4-Grama Panchayat Khilegaon, as a Computer Operator and Wireman. His -3- services are said to have been terminated after about three years of working as a Computer Operator. The petitioner thereafter submitted a representation seeking reinstatement into service or to give effect to the order of the Appellate Authority dated 13.05.2016. It transpires that no order has been passed by the State either accepting or rejecting the order of the Appellate Authority. Consequently, the petitioner submitted a further representation on 24.06.2016.
4. The order passed in appeal is stated to have been kept in cold storage by the respondents. Therefore, the petitioner is before this Court.
5. In light of the petitioner’s representations which are
pending consideration before respondent Nos.3 and 4, respondent Nos.3 and 4 shall now take note of the order of the Appellate Authority and pass necessary orders thereon, if not already passed as on today.
6. If an order has already been passed, the petition shall stand rendered infructuous, reserving liberty to the petitioner to avail such remedy as may be available in law, in the event he is aggrieved. -4-
7. In the event no order has been passed on the representation dated 13.05.2016, the respondents shall pass an
order within an outer limit of 12 weeks from the date of receipt
of a copy of this order, if not earlier.
