2. The present appeal under Section 96 of the CPC seeks following
prayers:- “ It is, therefore most respectfully prayed that the Impugned judgment and decree dated 04/03/2010 passed by Dr. Kamini Lau: Ld. Addl. Distt. Judge, Delhi dismissing suit no. 168/2006 of appellant may kindly be set aside and Civil Suit No. 168/2006 may kindly be decreed with cost through out Any other relief, which this Honorable Court may deem fit and proper in the facts Ss circumstances of the case, may also be granted in favour of Appellant and against the Respondent. Prayed accordingly.”
3. Appellant no. 2 Mangat Ram @ Mangat Chaudhary, who is also power of attorney holder for appellant no. 1, appears through a video conference today.
4. Learned counsel appearing on behalf of the appellants, on instructions from the latter, seeks leave to withdraw the present appeal.
