1. This is a writ petition filed under Articles 226 and 227 of the
Constitution of India seeking the following prayers:- “a) A writ of mandamus and appropriate directions be passed directing the respondents to remove and demolish the unauthorized construction raised in the form of a hall at the parking/stilt area adjoining and adjacent to the said Flat no. A-25 of Petitioner i.e. at the said parking area cum stilt area of the A-block building of the Airport Co-operative Group Housing Society, Plot no. 9, Phase II, Budhella, Vikas Puri,
New Delhi-110018. b) A writ of Mandamus and appropriate directions be passed to reinstate the parking/stilt area, common area, shaft area and access to the pipelines etc. on the said parking/stilt area of the A-Block building of the Respondent no.4 society after demolishing the aforesaid illegal and unauthorised construction thereupon. And to restrain and restrict the re- raising of the any such similar, wrongful, illegal, unauthorised, and unpermitted construction in the said parking area cum stilt area at the ground floor of the A-block building of Respondent no.4 society or near the said flat of Petitioner. c) A writ of Mandamus and appropriate directions be passed against the Respondents to restrain, cease, restrict, stop and forthwith prohibit the conduct of aforesaid disruptive, illegal, unpermitted and wrongful activities or loud noise and nuisance creating activities, as stated hereinabove, anywhere near, adjacent or adjoining the flat of Petitioner at the area where the aforesaid unauthorized construction is raised or anywhere in the A-Block building of the Respondent no.4 society; and the Respondent no.3 be directed to take strict action against such activities and act/respond to the complaints raised by the Petitioner in respect thereof by taking appropriate legal action against the erring person and office bearers of Respondent no.4 society i.e. its Secretary (Respondent no.6) and President (Respondent no.5).
d) Appropriate directions be passed directing the Respondents to forthwith stop the misuse and wrongful utilization of the funds of the society and to take strict legal action against the concerned office bearers of the said society including against its President Shri R.P. Singh (Respondent no.5) and its secretary Shri J.P. Singh (Respondent no.6) for their acts of cheating, fraud and misappropriation of funds for wrongful, illegal and unpermitted activities. e) Appropriate be passed against the Respondent no.4 to 6 directing them to perform the maintenance activities in respect of the Petitioner’s flat and its surrounding area. f) Award appropriate Compensation to the Petitioner of Rs. 5,00,000/- (Rupees Five Lakhs) for the harassment, difficulty, humiliation and loss caused to the Petitioner due to the aforesaid wrongful unauthorized construction and aforesaid wrongful and illegal activities causing extreme harassment and towards the cost for the present petition. ...”
2. Mr. Dhawan, learned standing counsel for the DDA, has drawn my
attention to “Fresh Status Report By Way Of Affidavit On Behalf Of Respondent No. 1 DDA” dated 30.10.2025, wherein it is stated that illegal and unauthorized construction at Airport Co-operative Group Housing Society Ltd. has been removed from Block-‘A’ stilt area of Airport Apartment Vikaspuri, New Delhi-110018 and hence the grievance of the petitioner stands satisfied.
3. Additionally, Mr. Aggarwal, learned counsel for the petitioner, states that the area meant for parking shall be used for parking and no other purposes.
4. Ms. Nagpal, learned counsel for the respondent Nos. 4 to 6, on instructions states that the area in question shall only be used for parking and no other function shall be carried out.
5. Binding the respondent No. 1/DDA to the “Fresh Status Report By
Way Of Affidavit On Behalf Of Respondent No. 1 DDA” dated 30.10.2025 and respondent Nos. 4 to 6 to the statement of Ms. Nagpal, learned counsel, the present petition is disposed of, along with pending applications, if any.
