% 28.03.2026 The present matter is listed today i.e. 28.03.2026, since 02.03.2026 was declared a holiday. The State has filed the present petition on 17.10.2019 against acquittal. Notice on the present leave petition was issued on 18.10.2019. Thereafter, despite 12 dates having been passed, the State has taken no steps to serve the respondent. Yet again, vide order dated 06.11.2025, another opportunity was granted to the State to serve the respondent as well as his surety on filing of process fee and taking requisite steps for 02.03.2026. Office Report dated 27.03.2026 indicates that no steps were taken for service of the respondent. In view of the unexplained and inordinate failure on the part of the State to serve the respondent, the present leave petition is dismissed for non- prosecution.
