ORDER
% 29.05.2026 The matter is taken up today as 28.05.2026 was declared a holiday on account of ‘Id-ul-Zuha (Bakrid)’.
1. In compliance with order dated 18.05.2026, passed in the present
proceedings, the concerned representative Mr. Saumyajit Das, official from M/s SREI Equipment Finance Limited, who is well-versed with the facts and circumstances of the present case, is present in Court today. He submits that he has been duly authorised by Board Resolution of M/s SREI Equipment Finance Limited to appear in these proceedings and make appropriate statement before this Court.
2. He states on behalf of M/s SREI Equipment Finance Limited that there
is no objection whatsoever on behalf of the M/s SREI Equipment Finance Limited for transfer of the concerned rakes to the Union of India. He affirms and acknowledges that the M/s SREI Equipment Finance Limited neither asserts any right/s whatsoever in the said rakes, nor is there any charge or lien in favour of the M/s SREI Equipment Finance Limited (or any group company)
in respect thereof. It is agreed that there is no impediment whatsoever in transferring absolute title in respect of the said rakes to the Union of India. The said statement is taken on record.
3. The respondent no.1, the Director of Aviral Minerals Pvt. Ltd., who appears virtually, also affirms that:
(i) The physical possession of the rakes is already with the Union of India.
(ii) The title in the rakes is required to be vested absolutely in favour of the Union of India/the petitioner.
4. He states, on instructions, that for the said purpose, the respondent no.1 shall execute such documents as may be required by the petitioner.
5. It is agreed that all the documents in the possession of the respondent no.1/Director, Aviral Minerals Pvt. Ltd. in respect of the rakes, shall be handed over to the Union on India.
6. Let the Union of India sent the requisite documentation that is required to be executed by the respondent no.1 for transferring the absolute title in rakes in favour of Union of India.
7. It is agreed that the said documents shall be executed by the respondent no.1 within a period of 2 weeks from the date of receipt.
8. Needless to say, the same shall be without prejudice to any money claim being pursued by the respondent no.1 against the Union of India.
9. The present petition stands disposed of in the above terms. Pending application also stands disposed of. SACHIN DATTA, J MAY 29, 2026/at/sl
