1. This transfer petition has been registered on the basis of a

communication dated 29.01.2026 received from the learned Principal District and Sessions Judge (Central), Tis Hazari Courts, stating that the proceedings are required to be transferred to the Special/Designated Court, as charges have been framed in respect of Scheduled Offences under the National Investigation Agency Act, 2008 [“NIA Act”].

2. By order dated 24.02.2026, the Court recorded as follows:

“2. Notice was issued on 09.02.2026, pursuant to which accused Fazil is present in person, and co-accused Mohsin is represented by Mr. V.S. Mishra, learned counsel.

3. Mr. Tarang Srivastava, learned Additional Public Prosecutor,

submits that service shall be effected upon Jubair @ Sonu in accordance with law during the course of the day.

4. Mr. Mishra and accused Fazil, who is present in person, submit that

they have no objection to the transfer in view of the provisions of the NIA Act.

3. In pursuance of the order dated 24.02.2026, Mr. Mohd. Yusuf,

learned counsel for accused No. 3, appears and submits that accused Jubair @ Sonu (accused No. 3) is present in Court. Mr. Yusuf states that accused No. 3 has no objection to the transfer of the proceedings in view of the provisions of the NIA Act.

4. In view of the above, and having regard to the fact that charges

have been framed in respect of Scheduled Offences under the NIA Act, it is directed that the proceedings in Sessions Case No. 818/2024 titled ‘State v. Fazil & Ors.’, presently pending before the jurisdictional Court in the Central District, Tis Hazari Courts, be transferred to the Special Court under the NIA Act at Patiala House Courts, New Delhi.

5. The matter be placed before the learned Principal District &

Sessions Judge, Patiala House Courts, New Delhi, on 10.03.2026 at 2:00 P.M. for further directions.

6. The Investigating Officer is directed to inform the remaining

accused accordingly.
