(ORAL) The above captioned two Appeals arise out of F.I.R. No.109/2013 under Sections 392/394/397/4
I.P.C. registered at Police Station Karawal Nagar.

2. In pursuance to the last order, appellants are present in the Court. Vide impugned judgement of 31st March, 2018 and order on sentence of Crl.A. 753/2018 & connected matter Page 1 of 2 6th April 2018, appellants have been convicted and sentenced to undergo rigorous imprisonment for 5 years and 4 years respectively for the offence under Section 3
IPC with fine and default clause.

3. With the consent of learned counsel for both the sides, these two appeals have been heard together and are disposed of by this common order.

4. Upon hearing, and on perusal of evidence on record, I find that conviction of appellants is well merited. No minimum sentence is provided for the offences in question. Appellants are first offenders and they have family to support. The nominal roll of the appellants have been perused and it is deemed appropriate to reduce the substantive sentence awarded to appellant- Ranjeet @ Rana from 5 years to 3½ years while maintaining the fine of sentence. The substantive sentence of appellant Sumit Kumar @ Bali is also reduced from 4 years to 3 years while maintaining the fine of sentence. In the case of Ranjeet @ Rana, the sentence in default of payment of fine is reduced from 4 months to simple imprisonment for 2 months. In the case of Sumit Kumar @ Bali, the sentence in default of payment of fine is also reduced from 3 months to one month.

7. With the aforesaid modification, the above captioned two Appeals are accordingly disposed of.
