(Common Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C., praying to direct the 3rd respondent to register a case on the petitioner's complaint dated 01.01.2016 and investigate and proceed with the same as per law within time frame fixed by this Honourable Court and pass such further or other orders as this Honourable Court may deem fit and proper in the circumstances of the case.)
1. This petition has been filed to direct the 3rd respondent to register a case on the petitioner's complaint dated 01.01.2016 and investigate and proceed with the same as per law.
2. Heard the learned counsel for the petitioner, learned Government Advocate (Crl.Side) appearing for the State and perused the materials placed on record.
3. On reading of the complaint dated 01.01.2016, it is alleged by the petitioner that she received a free patta for her land sometime in the year 2001 and that the Tahsildar is giving false information to his higher officers in order to usurp the said land.
4. The complaint does not disclose the commission of a cognizable offence and in order to give a criminal colour to the allegation, the petitioner has stated that the Village Assistant came to the house of the petitioner and threatened her. The petitioner has not even given the date on which the alleged incident had taken place. Hence, no positive direction can be issued to the respondent police to register an FIR.
5. Accordingly, this petition is closed with liberty to the petitioner to work out her remedy before the appropriate forum in the manner known to law.
