2. Heard the learned counsel for the Petitioner and perused the materials on record.

3. Perusal of the records would reveal that suit in O.S.No.96 of 2012 has been adjourned half a dozen occasions, for examination of witnesses and hence, the suit is pending for a long time, without any progress.
