(Prayer: Writ Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus, directing the 1st respondent to take necessary action to provide adequate police protection to the petitioner and her husband, namely, S.Arun, S/o.Sankaran and his family members and consequently direct the 1st respondent to forbear the respondent nos.4 and 5 and the henchmen of the respondents 4 and 5 from interfering with the peaceful matrimonial life of the petitioner.)

The writ petition has been filed, seeking to direct the 1st respondent to take necessary action to provide adequate police protection to the petitioner and her husband, namely, S.Arun, S/o.Sankaran and his family members and consequently direct the 1st respondent to forbear the respondent nos.4 and 5 and their henchmen from interfering with the peaceful matrimonial life of the petitioner.

2. Heard the petitioner / party-in-person and the learned Additional Government Pleader appearing for the respondents 1 to 3.

The case of the petitioner is that she is aged 19 years, doing 2nd year Engineering Course; that she fell in love with one Arun, who has also completed his graduation in Engineering and that as the petitioner and the said Arun belong to a different community, the father of the petitioner refused to accept their love and decided to arrange marriage of the petitioner with her aunt's son, aggrieved over which, the petitioner came out of her parental home and married Arun in a Temple on 15.06.2016.

When the matter was taken up for hearing on 22.06.2016, this Court directed the petitioner to be personally present before this Court along with the Ration Card, which is stated to have been taken away by her. Today, the petitioner along with her husband and other respective parties are present and the case has been heard in Chamber.

On enquiry with the petitioner, she has stated that after marriage, she is now living with her husband in the matrimonial home and her marital life is being disturbed by her father and brother, who are respondents 4 and 5 herein and that made her to lodge a complaint with the respondent police seeking for police protection. She has admitted that she is in possession of the ration card, belonging to her parents and has agreed to hand over the same to her parents today with a condition to return back the same for registration of their marriage etc. and she has also given a written undertaking in the Court bundle to that effect.

6. Per contra, the parents of the petitioner denied the averments made by the petitioner in the affidavit. However, the parents and brother of the petitioner have given undertaking that they will not interfere in the matrimonial affairs of the petitioner hereafter. The undertakings given by the respective parties are hereby recorded.

7. In view of the above undertakings, this Writ Petition is closed. Consequently, connected miscellaneous petition is also closed. No costs.
