* IN THE HIGH COURT OF DELHI AT NEW DELHI Date of Decision: November 24, 2014 + CM(M) 972/2014 ARVINDER KAPOOR Through: ..... Petitioner Mr. Sanjeev Mahajan, Advocate versus RUCHI KAPOOR ..... Respondent Through: Nemo. CORAM: HON'BLE MR. JUSTICE SUNIL GAUR JUDGMENT
ORAL % C.M.No.17953/2014 Allowed subject to all just exceptions. CM(M) 972/2014 Divorce petition filed by petitioner is stated to be pending before the concerned family court since the year 2012. The prayer made in this petition is for expeditious disposal of the said petition, which is now listed for evidence on 15th July, 2015. At the hearing, learned counsel for petitioner had drawn attention of this Court to impugned order of 12 th September, 2014 (Annexure P-16) to point out that an adjournment of one year has been granted by the C.M.(M) No.972/2014 Page 1 concerned family court and if such long adjournments are granted, then it will take about five years more to get the said petition decided. Upon hearing and on perusal of impugned order and material on record, I find that the appropriate course for petitioner would be to seek pre-ponement of date for recording of evidence by filing an application before the concerned family court. In view of above, this petition is disposed of with aforesaid liberty to petitioner. (SUNIL GAUR) JUDGE NOVEMBER24 2014 r C.M.(M) No.972/2014 Page 2
