IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 03.07.2013 CORAM THE HONOURABLE Mr.JUSTICE K.RAVICHANDRABAABU C.R.P.(NPD) No.2402 of 2013 K.Arunagirinathan .Petitioner ..vs.Venugopal .Respondent Prayer: Civil Revision Petition filed under Article 227 of the Constitution of India to direct the District Munsif Court, Chengam to dispose of the application in I.A.No.50 of 2012 in O.S.No.215 of 2005 filed by the petitioner.

This civil revision petition is filed seeking for a direction to the court below to dispose of I.A.No.50 of 2012 in O.S.No.215 of 2005 at an early date.

2.Learned counsel appearing for the petitioner submits that the petitioner has filed the said application under section 5 of the Limitation Act, seeking to condone the delay of 2518 days in filing Order 9 Rule 13 C.P.C.application.

Though the said application was filed as early as on 26.09.2012, till this date the application is not disposed of.

3.Learned counsel appearing for the petitioner further ascertained that the said application is still pending even as on date and therefore, a suitable direction may be issued to the court below.

4.Considering the very limited prayer sought for in this civil revision petition, without expressing anything on merits of the application filed under section 5 of the Limitation Act, I only direct the court below to dispose of I.A.No.50 of 2012 in O.S.No.215 of 2005, within a period of 30 days from the date of receipt of a copy of this order.
