28. h October, 2014. PRESENT HON'BLE Dr. JUSTICE VINEET KOTHARI Appearance: Mr. Girish Sankhala, for the petitioner. <<>> BY THE COURT:

1. The petitioner has filed the present writ petition on 14.10.2014 with the following prayers:- “The petitioner prays for the following reliefs: - (i) That, the respondents may kindly be directed for granting appointment to the petitioner on the post of Safaiwala as a Class IV employee in pursuance to list of appointees dated 22.01.2014 issued by the respondent Municipal Board, Sirohi, Rajasthan. S.B. CIVIL WRIT PETITION No.7424/2014. Maya Devi Vs. The State of Rajasthan & Ors. Final Order dated 28.10.2014. 2/3 (ii) That the respondent Municipal Board, Sirohi, may further be directed to discharge its duty in fair manner. (iii) That any other reliefs for which the petitioner is entitled in eye of law may kindly be granted.”. 2. The petitioner has filed the present writ petition being aggrieved of his selection as Safai Karamchari in the Municipal Council, Pali for which the selection process was held on 16.08.2013 and despite,s he is being selected, she was not allowed to join her duty and to perform regular duty.

It appears that before coming to this Court, the petitioner has submitted representations to the Respondent - Commissioner, Municipal Council, Sirohi vide Annex.19 dated 22.05.2014 and Annex.20 dated 24.06.2014 but without awaiting decision thereupon, the petitioner has preferred the present writ petition. In the circumstances of the case, therefore, the writ petition is considered premature.

Accordingly and in view of the above, the writ petition is disposed of with a liberty and direction to the petitioner to pursue her representations dated 22.05.2014 and 24.06.2014 submitted to the Respondent - Commissioner, Municipal Council, Sirohi, and the said Respondent is expected in law to pass appropriate and speaking order in this regard and if the petitioner is otherwise found eligible and entitled to join his duties as Safai Karamchari upon her S.B. CIVIL WRIT PETITION No.7424/2014. Maya Devi Vs. The State of Rajasthan & Ors. Final Order dated 28.10.2014. 3/3 selection, appropriate orders may also be passed by the said Respondent.
