1. The petitioner has filed the present writ petition on 10.10.2014 with the following prayers:- “It is, therefore, most humbly and respectfully prayed that by an appropriate writ, order or direction - a. The order dated 14.08.2014 whereby the Government Primary School, Nai Abadi, Kadwa Amari had been merged into Government Secondary school, Kadwa Amari be quashed and set aside. b. Any other appropriate order, which this Hon'ble Court deems fit and proper, be passed in favour S.B. CIVIL WRIT PETITION No.7199/2014. Divya Prasad Sharma Vs. State & Ors. .. Final Order dated 27.10.2014. 2/3 of petitioner. c. That writ petition be allowed with costs.”. 2. The petitioner, who is working as a Teacher Gr. III in the School which is sought to be merged, has filed this writ petition being aggrieved by the impugned merger order Annexure-2 dated 14.08.2014.
3. It appears that the petitioner has filed a representation through the Head Master of the School vide Annexure-3.
4. In all these similar kind of matters, this Court recently relegated the petitioners/teachers/affected school to the authorities concerned for redressal of their grievances. On being informed on behalf of the respondents that a Committee headed by the concerned District Collector along with District Education Officer concerned and Additional Chief Executive Officer of the respective Zila Parishads has already been formed by the State Government to look into the grievances and the difficulties/problems of the staff of the school (s) sought to be merged by the State Government under the policy for unification and rationalisation (एक करण एव सम न करण) and, therefore, the petitioner of the present writ petition Mr. Divya Prasad Sharma is relegated back to the said Committee for decision of his representation to be filed afresh by him.
5. Accordingly and in view of the above, this writ petition is disposed of with a direction and liberty to the petitioner to approach S.B. CIVIL WRIT PETITION No.7199/2014. Divya Prasad Sharma Vs. State & Ors. .. Final Order dated 27.10.2014. 3/3 the said Committee headed by the District Collector, Banswara. In the first instance, the petitioner may appear before the said Committee on 10.11.2014 and the petitioner will also be free to file additional representation ventilating all his grievances and problems and the said Committee headed by the District Collector, Banswara is expected in law to decide the said representation of the petitioner, preferably after giving an opportunity of hearing to the petitioner within one month from today.
