The petitioner being graduate and having the qualification of B.

applied for the post of Teacher Grade II (Social Science) in pursuance of the Advertisement dated 02.08.2013 (Annex.2).The petitioner belongs to TSP area being the resident of District Basnwara.

It has further been averred by the petitioner although she belongs to TSP area, however, in the on-line application there was no criteria laid down in the format of the application form regarding the category of TSP.

In the aforesaid competitive examination, the petitioner secured 143.84 marks, whereas the cut off marks for the post of Teacher Grade- II (Social Science) for General Women WD was 214.36 and for S.B.CIVIL WRIT PETITION No.6994/2014.

Neelam Salgiya versus State of Rajasthan & ORS.Order dated 09/10/2014 2/3 the TSP (General Women WD) the cut off marks were 124.80.

According to petitioner, although she has secured higher than the last cut off marks, however, the petitioner has not been given appointment on the post of Teacher Grade II though she being the resident of district Basnwara, also belongs to TSP area.

Before filing the present writ petition, the petitioner has already filed a representation dated 23.09.2014 (Annex.10) and the present writ petition has been filed on 01.10.2014 seeking following reliefs: - “It is, therefore, humbly and respectfully prayed that this writ petition of the petitioner may kindly be allowed: - A.

By an appropriate writ order or direction, the respondents may kindly be directed to consider the candidature of the petitioner under the TSP (Gen) category and consequently, consider his candidature for the post of Teacher Grade-II Social Science in pursuance of the advertisement dated 2.8.2013 (Ann.2).B.By an appropriate writ order or direction, the respondents may kindly be directed to consider the candidature of the petitioner in the category of TSP (Gen) instated of General and afford his appointment on the post of Teacher Grade-II (Social Science) with all consequential benefits if otherwise he stands in merit.
