The petitioner was working as 'Gram-Sevak' in the respondent Panchayat Samiti- Kapasan, District: Chittorgarh and he was placed under suspension vide order (Annex.1) dated 25.11.2010 in contemplation of enquiry initiated against him vide Annex.2 dated 10.12.2010.

(ii)That the respondents may kindly be directed to allow the petitioner all service i.e.regular pay scale, D.A.etc.benefits which have been withheld due to imposing of suspension upon the petitioner, with all consequential benefits.

(iii)Any other relief to which the petitioner is entitled, may be granted in his favour.

(iv)The writ petition may be allowed with costs.”

After hearing the learned counsel for the petitioner, this Court is not inclined to interfere in the matter in the writ jurisdiction under Article 226 of the Constitution of India.

It is for S.B.Civil Writ Petition No.6801/2014 Aziz Mohammed Sheikh versus State of Rajasthan & ORS.Order dt: 01/10/2014 3/3 the respondent Department and the concerned appointing authority to consider the case of the petitioner for revocation of the suspension order or reinstatement, once the enquiry against the petitioner has been concluded and if any other disciplinary action is not pending against the petitioner, the respondent Department ought to have considered the case of the petitioner in accordance with law.

The petitioner will be also at liberty to cite the relevant Government Circular for revocation of the prolonged suspension before the concerned authority but no such mandamus directions can be issued by this Court, as prayed for.

Accordingly, the present writ petition is found to be devoid of any force and the same is hereby dismissed.

No costs.
